Authorize a public hearing to be held on October 11, 2016, regarding a proposed ordinance restricting groundwater wells, other than Florida Department of Environmental Protection (FDEP)-approved monitoring wells, from being placed in County-owned or operated rights-of-way (ROW).

Summary:

Approval of this new County ordinance will prohibit the installation of groundwater wells in County-owned or operated ROW in an effort to eliminate or reduce the risk of exposure to users or occupants of the ROW to current and future groundwater contamination.

 

Background Information:

FDEP has previously identified areas of groundwater and soil pollution in County ROW.  In an effort to eliminate or reduce the risk of exposure for users of County-owned or operated ROW, to current and future soil and groundwater contaminants, staff recommends adopting the attached ordinance.  The ordinance restricts groundwater wells, with the exception of FDEP-approved monitoring wells, from being placed within County-owned or operated ROW.  FDEP has confirmed that this ordinance is an effective institutional control that will likely eliminate or reduce said risks.
