Summary:

Approval of the consent order will resolve asbestos air quality violations.  The Respondent has agreed to the terms outlined in the attached consent order, including a penalty of $45,520.00 to be paid by the Respondent into the Pinellas County Air Pollution Recovery Trust Fund.

 

Background/Explanation:

The Air Quality Division is recognized by the Environmental Protection Agency (EPA) and State of Florida Department of Environmental Protection as a local program and has authority to administer and enforce the Federal Asbestos Regulation through program delegation.

 

On November 9, 2015, Air Quality Division (AQD) received an anonymous complaint regarding renovation activities in progress on the real property known as Sailpointe Apartments located at 6740 & 6742 Gulf Port Boulevard, South Pasadena, Florida. The Division conducted multiple inspections and laboratory analyses to determine the type and severity of the air quality violations. The Respondent will pay the penalty of $45,520.00 in three installments as follows: the first payment of $15,173.34 on or before May 30, 2016, the second payment of $15,173.33 on or before June 30, 2016 and the third payment of $ 15,173.33 on or before July 30, 2016.

 

Fiscal Impact:

$45,520.00 will be added to the Pinellas County Air Quality Pollution Recovery Fund Pursuant to the schedule in the attached Consent Order. 

 

Delegated Authority:

Pursuant to Resolution No. 94-63, the County Administrator or his designee only has authority to execute consent orders for a penalty amount of $25,000 or less. Consent Orders over $25,000 must be executed by the Board of County Commissioners.
