Summary:

Plaintiff filed a two count complaint in the United States District Court, Middle District of Florida, alleging that the County interfered with her Family and Medical Leave Act of 1993 (FMLA) rights while she was employed by the County as a 9-1-1 dispatch center operator.  Plaintiff contends that her mother suffered from a medical condition that qualified her to request FMLA leave, submitted proper documentation to leave to care for her mother, but was terminated from her employment for her absence.  Plaintiff seeks an injunction to restrain the County from alleged continued violations of the FMLA, compensation for lost wages and benefits, reinstatement to her employment with back pay and benefits, and attorneys’ fees.  The County disputes Plaintiff’s factual and legal contentions.

The County Attorney’s Office will bring all responsive motions, counterclaims, cross-claims, or third party claims as necessary or appropriate in the judgment of the County Attorney.
