Summary:
The current County ordinance does not allow for construction of paver driveways by property owners without a variance process. This amendment will provide property owners with the option of constructing concrete pavers or clay bricks on their driveway entrance, including the driveway pedestrian area in the right-of-way that connects sidewalks on each side of the driveway.
The proposed ordinance would impact all residents on County roads except where a municipality has the responsibility for sidewalk maintenance. Generally, municipalities have the responsibility for sidewalk maintenance on County roads where, 1) the County and the municipality enter into an interlocal agreement whereby the municipality assumes sidewalk maintenance responsibilities, and 2) the roadway in question is a functionally reclassified roadway that enters into and through a municipality, in which case the provisions of Resolution 00-269 and state law apply.
Background Information:
This option is desirable by property owners that consider paver driveways an aesthetic enhancement to their property and neighborhood. If the property owner chooses to construct a paver driveway, they will be required to follow County standards and maintain the pavers in a tight uniform configuration that provides a smooth Americans with Disabilities Act-compliant surface for wheelchair users crossing the driveway along a sidewalk route. The property owner will also have the liability and financial responsibility associated with any future maintenance deficiencies.
