Approval of the Joint Participation Agreement (JPA) with the Florida Department of Transportation (FDOT) accepting reimbursable funding for purchase of traffic control, detection, and communication equipment for the State Road (SR) 60/Gulf to Bay Boulevard from Missouri Avenue to Dr. Kiran C. Patel Boulevard.

 

                     Funding in amount of $1,800,000 is included in FDOT’s five-year work program for the purchase of traffic control, detection, and communication equipment on SR 60/Gulf to Bay Boulevard.

                     FDOT agrees to reimburse County for purchase of equipment authorized under the JPA up to the total program amount.

                     If approved, funding in the amount of $1,800,000 will be programmed in the Fiscal Year (FY) 2023-FY28 Capital Improvement Program 6-year Plan Transportation Plan, ATMS Project.

                     County shall be responsible for maintenance of new equipment through the existing Traffic Signal Maintenance and Compensation Agreement.

 

FDOT Financial Project Number: 449244-1-93-01, County project number 004974A - ATMS Pinellas County ATCMTD Connected Community Project. FDOT funding in the amount of $1,800,000.00; Equipment to be purchased must be identified and approved by October 1, 2022, with requisition process completed by December 31, 2022, and project completion no later than December 31, 2023; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary

Through this Agreement, FDOT District 7 will provide the County funding to expand its ATMS network within the SR 60/Gulf to Bay Boulevard corridor, from Missouri Avenue to Dr. Kiran C. Patel Boulevard in Clearwater. The County will be responsible for procurement of new traffic control, detection, and communication equipment for seventeen (17) signalized locations along the SR 60/Gulf to Bay Boulevard corridor.  Closed-circuit television (CCTV) cameras will be located at six (6) signalized intersections, and enhanced pedestrian detection at three (3) signalized intersections.

The County is also responsible for the inspection, installation, integration, and maintenance of any new equipment. The project is included in the FDOT 5-year Work Program.  It is anticipated County staff will perform most of the equipment installation on the Corridor.  The equipment is to be purchased by October 1, 2022, and project completion no later than December 31, 2023.

Background Information:

The County’s annual Citizen Value Survey aligns citizen expectations with their day-to-day experience. Traffic and congestion have continuously been listed together as one (1) of the top five (5) largest gaps in the Survey. Smooth traffic flow on major roads along with safe bicycle and pedestrian travel are all noted as citizen expectations. The completion of the project along the SR 60/Gulf to Bay Boulevard corridor will help to close the gap between citizen experience and expectation of traffic flow on the County’s Route-of-Significance, or priority State corridor, by enhancing its operational performance for all road users. Project supports expansion of County’s advanced traffic management system (ATMS) network with deployment of connected vehicle (CV) technologies along SR 60 corridor.

The County and the City of Clearwater (City) are responsible for managing safety, congestion, and capacity along the roadways of their jurisdictions, which often overlap. The project involves the installation of CV devices and technology integration within the County’s and City's existing infrastructure. The real-time traffic related data collected will be used to improve the mobility of drivers, reduce congestion, and provide for more efficient and accessible transportation.

Per Section 4, Paragraph 4.2, the County agrees to include the following indemnification in all contracts and/or standard purchase orders:  “Each contractor/consultant shall indemnify, defend, save and hold harmless the Department and all of its officers, agents or employees from all suits, actions, claims, demands, liability of any nature whatsoever arising out of, because of, or due to, any intentional act and/or negligent act or occurrence or omission or commission of the contractor, its officers, agents or employees. Neither the contractor/subcontractor, consultant/sub consultant, nor any of its officers, agents or employees will be liable under this section for damages arising out of injury or damage to persons or property directly caused or resulting from the sole negligence of the Department or any of its officers, agents or employees.”

 

Fiscal Impact:

If this agreement is approved, FDOT JPA funding of $1,800,000.00 will be programmed in the FY23-FY28 Capital Improvement Program (CIP) 6-Year Plan: Transportation function: Advanced Traffic Management System program, under CIP project 004974A - ATMS Pinellas County ATCMTD Connected Community Project. 004974A - ATMS Pinellas County ATCMTD Connected Community Project is an existing project within the FY22-FY27 CIP plan and is currently funded by Local Option Fuel Tax (LOFT) and a federal grant with the U.S. Department of Transportation.

 

The SR60-Gulf to Bay Corridor covered in this agreement was originally included in project 004974A’s project area and scope, however, there is additional equipment or systems FDOT has asked the County to include. The $1,800,000.00 will cover the cost of these additions but does not reduce the federal grant or LOFT amounts programmed in the CIP plan.

 

Funding is made available during FDOT’s current fiscal year (July 1 - June 30, 2022). FDOT will reimburse the County up to $1,800,000.00 for the purchase of authorized equipment. All expenditures exceeding that amount and are related to the project are the responsibility of the County. FDOT will not reimburse expenditures that took place prior to issuance of FDOT’s Notice to Proceed. The County is to submit one invoice to FDOT once the project is complete.
