Consider granting the petition to vacate, and if granted, adopt the attached resolution pursuant to Florida State Statute 177.
• The private drainage easement is recorded on the plat.
• Runoff flow through a drainage swale contained within the easement will not be adversely affected by the vacation.
Authorize the Clerk of the Court to attest and record the resolution in the Public Records of Pinellas County.

Summary:
The purpose of this request is to vacate four (4) feet of a fifteen (15) foot private drainage easement for installation of a screened pool and deck.
Background Information:
At the County’s request the petitioners provided drainage calculations from a civil engineer to support the request to reduce the drainage easement size. The calculations demonstrate reducing the size of the easement will not adversely affect the runoff flow through a drainage swale contained within the easement. Furthermore, the property owner will be required to provide and secure access to the drainage easement for maintenance purposes.
County departments were queried and have no objection to the vacation request.
Letters of no objection were received from Bright House, Clearwater Gas System, Duke Energy, Frontier, Manning Oaks Homeowner’s Association, Pinellas County Utilities Engineering, SWFMWD, TECO Gas and WOW!
The petition was properly advertised in accordance with Florida State Statute 177. Pursuant to the Real Property Division Procedures, notice was mailed by the Clerk of the Court to property owners within two hundred feet of the subject property. The Deputy Clerk will report to the Board any citizen support or opposition.
