Approval of the petition to vacate a portion of a 16-foot unimproved platted alley adjacent to and a 16-foot public alley easement on the property at 5326 34th Street North in Lealman. (Legislative)

 

                     Request is for the vacation of a portion of an unimproved platted alley and a public alley easement.

                     Petitioner request is part of a redevelopment project on the site for a new automobile dealership.

                     Staff recommends approval contingent upon the retention of a 16-foot public alley access easement on the petitioner’s property that would replace the existing public alley easement.

                     The requested easement will allow traffic entering the alley to have an exit without backing out.

                     If petition is granted, Board of County Commissioners is asked to adopt the attached Resolution pursuant to Florida State Statute 336.09.

 

Authorize the Clerk of the Circuit Court to record the resolution in the public records of Pinellas County.

Summary

The purpose of this request is to vacate a portion of a 16-foot-wide unimproved alley adjacent to the petitioner’s property and 16-foot public alley easement on the property. The petitioner has agreed to retain a new 16-foot-wide public access easement on the petitioner’s property to allow for continual access through the alley and out to 53rd Avenue N. The petitioner will be redeveloping the site with an automobile dealership.

Background Information:

The petitioner’s property contains an automobile dealership. The petitioner is proposing to redevelop the property for a new dealership. As the petitioner expanded development on the site, the Commission has granted previous vacations of portions of the alley. The most recent alley vacation had a condition of retention of a public access easement on the property to allow for traffic to continue through the alley and exit onto 53rd Avenue N. This vacation request includes an agreement for a new public access easement that will align with the proposed driveway of the redevelopment.

County staff reviewed the request pursuant to Pinellas County Land Development Code Section 154-272, Criteria for Consideration, and have no objections to the vacation request subject to retention of the public access easement. The petition was properly advertised in accordance with Florida State Statute 336.10. Notices were mailed by the Clerk of the Court to property owners within 250 feet of the subject property. The Deputy Clerk will report to the Board any citizen support or opposition.

Letters of no objection were received from TECO, TECO People Gas, WOW, Frontier, Spectrum and Duke Energy.

 

Fiscal Impact:

 

$750 has been received as a Petition Fee from Petitioner for this request.
