Approval and execution by the County Administrator of the extension and increase with County Recycling, Inc. d/b/a County Sanitation Service for Lealman residential waste collection and disposal services.
• This contract is for requirements of Lealman residential waste, recyclables, yard, and bulky waste collection, and disposal services.
• First Amendment increases the total contract expenditure by $8,000,000.00 and extends the contract term by sixty months for the Lealman residential waste collection and disposal services.
• Section 4(B) of the original agreement allows for an additional sixty-month period pursuant to the same terms and conditions of the original agreement.
• The County Administrator is authorized to approve term extensions that were included as a provision to the original Board of County Commissioners approved contract, per Code Section 2-188(d).
• The price difference between the original contract and the 60-month extension is due to applied index adjustments (consumer price index and fuel index adjustment) per the terms of the contract.
• This contract was originally approved by the Board of County Commissioners on July 19, 2016, in the amount of $6,500,000.00 for sixty months.
Contract No. 156-0364-B(LN) increase in the amount of $8,000,000.00 for a revised total expenditure of $14,500,000.00 and a revised contract end date of December 31, 2026.

Summary:
This extension and increase are for requirements of Lealman residential waste, recyclables, yard and bulky waste collection and disposal services. This service to Lealman citizens is provided by an exclusive franchisee under the provisions of a municipal service benefit unit approved by the Board of County Commissioners on December 6, 2005.
Background/Explanation:
This contract was originally approved by the Board of County Commissioners on July 19, 2016, in the amount of $6,500,000.00 for sixty months. This amendment will extend the contract term which is currently set to expire on December 31, 2021. The increased amount of $8,000,000.00 is the amount necessary for waste collection and disposal services to continue during the sixty (60) month term extension, inclusive of any index adjustments per the terms of the original contract.
Fiscal Impact:
Current contract expenditure not-to-exceed: $ 6,500,000.00
Extension and increase: $ 8,000,000.00
Revised expenditure not to exceed: $14,500,000.00
Funding is derived from the Lealman Solid Waste operating budget of the Solid Waste Department and is consistent with the FY22 Adopted Budget. A non-ad valorem special assessment is collected on residential tax bills to pay costs associated with the collection and disposal of residential municipal solid waste within the boundaries of the Lealman District. The fund balance is projected to remain positive, at the current annual assessment rate of $192.00, through the 2022 calendar year tax assessment. The fund will continue to be monitored to determine if and when a tax assessment increase is necessary to maintain a positive fund balance.
