Approval and execution by the County Administrator of Amendment No. 1 to the Construction Agreement with CSX Transportation, Inc. (CSXT) for the 46th Avenue North Railroad Crossing Improvements Project.
• Additional funding in amount of $59,399.00 required to complete tub-platform crossing surface upgrade and construction engineering and inspection and flagging services for proposed roadway resurfacing.
• The amendment is in-line with the original design we requested through CSXT. The additional cost will cover the milling/resurfacing, sidewalks on the north side along with curb and gutter.
• Originally, CSXT did not agree to those being in the scope of work and we would have incurred the expenses separately with our work order contractors.
• CSXT’s estimate of total Reimbursable Expenses for the Project is revised from $413,297.00 to $472,696.00 as shown in Exhibit A.
• Funding for sub-project, 46th Avenue Railroad Crossing Improvements 004678A, is budgeted under the Railroad Crossing Program PIV Project 004189A, included in the Capital Improvement Plan, funded by the Penny for Pinellas.

Summary:
Amendment No. 1 to the Construction Agreement requires additional funding in the amount of $59,399.00 to complete the tub-platform crossing surface upgrade and construction engineering and inspection and flagging services to cover the proposed roadway resurfacing. The Board of County Commissioners approved the original agreement on December 17, 2024, for the reconstruction and replacement of railway-highway grade crossings as part of CSXT’s systematic maintenance and railway improvement program.
The amendment also replaces Exhibit D of the Construction Agreement with Exhibit B - CSXT Force Account Estimate. Furthermore, Amendment No. 1 extends the agreement term to December 31, 2026.
Background/Explanation:
The amendment request is in line with the original design the County requested through CSXT, although this change will result in an increase in cost. Work under the Construction Agreement includes upgrade to the existing asphalt crossing surface with a concrete tub-platform to accommodate the proposed roadway improvements, which include roadway milling, resurfacing, and striping with the implementation of the dynamic envelope, along with curb and gutter installation. Work also includes installation of concrete sidewalks on both sides of the roadway within CSXT right of way.

The CSXT estimate of total Reimbursable Expenses for the Project is revised from $413,297.00 to $472,696.00, as shown in Exhibit B as part of Amendment 1. Therefore, required funding is increased by $59,399.00.
