Recommend the Board of County Commissioners (Board) consider granting the petition to vacate, and if granted, adopt the attached resolution pursuant to Florida State Statute 336, and authorize the Clerk to attest and record the resolution in the public records of Pinellas County.

Summary:

The subject petition seeks to vacate two (2), fifteen (15) foot platted alleys and two (2), six (6) foot platted alleys.

 

Background Information:

The original request from Louie and Kathy Kokkinakos sought to vacate a fifteen (15) foot platted alley and a portion of a six (6) foot platted alley, which would have landlocked the remaining alley behind lots 14-18.  County staff did not support the original request because of the lack of access to the remaining alley. 

Subsequent to the original vacation request, all of the property owners in this small subdivision agreed to request the vacation of the six (6) foot alley behind their respective property. A second fifteen (15) foot alley was also included in the amended request. The amended vacation request will eliminate any remnant left by the original vacation request and vacate other right-of-way not needed by the County.

County departments were queried and have no objection to the amended vacation request.   There are no County utilities in the vacation areas.  Additionally, appropriate staff members reviewed the subject areas and determined the vacation would not have an adverse effect on the remainder of the subdivision.  Letters of no objection have been received from Bright House, Public Works, Duke Energy (Distribution), Duke Energy (Transmission), TECO, Verizon and WOW!

The petition was properly advertised in accordance with Florida State Statute 336.  Pursuant to the Real Property Procedures, notice was mailed by the Clerk of Court to property owners within two hundred (200) feet of the subject property and two (2) yard signs were installed.  The Deputy Clerk will report any citizen support or opposition to the Board.
