Approval and execution by the County Administrator of Change Order No. 1 to the agreement with Cathcart Construction Company Florida, LLC for the MHC’s Wastewater Collection Systems Improvements Project ARPA - Package 3.

                     Cathcart Construction Company Florida, LLC was awarded $11,221,188.65 for construction of MHC’s Wastewater Collection Systems Improvements Project - Package 3 for the replacement and improvement of two wastewater collection systems in the Bel-Aire Mobile Homeowners, Inc. and Tropical Gardens Resident Owned Community, Inc. - which originally included Flowerwood Club Park Association, Inc.

                     Due to grant funding limitations, Flowerwood Club Park Association Inc. was not awarded with the original agreement.

                     Due to expected cost savings for ARPA, grant funding has become available for construction of the Flowerwood Club Park Association Inc. at the original bid pricing.

                     Change Order No. 1 reallocates $1,500,000.00 from MHC’s Wastewater Collection Systems Improvements ARPA- Package 2 (Companion Legistar Item 25-0939D) to MHC’s Wastewater Collection Systems Improvements ARPA- Package 3 to add capacity to the contract for the construction of Flowerwood Club Park Association, Inc.

                     This Change Order is allowable under the American Rescue Plan Act (ARPA) guidelines, as both Package 2 and Package 3 were obligated prior to the December 31, 2024, deadline. The requested Change Order constitutes an internal budget reallocation within the same approved ARPA project. It does not expand or alter the original scope or purpose of the project and remains fully aligned with the eligible use of funds for wastewater infrastructure improvements.

                     Added Attachment 8-A to Appendix 4 - Special Notices, Coronavirus State and Local Fiscal Recovery Funds (SLFRF).

                     Funding for the amendments to add the Flowerwood MHC is available under Manufactured Home Communities Wastewater Collection System Improvements, included in the FY26-FY31 Capital Improvement Plan, funded by the American Rescue Plan Act Fund, in the amount of $5,434,283.19.

 

Contract No. 24-0421-ITB-C; PID 005015A reallocation of $1,500,000.00 from Package 2 MHC to Package 3 MHC for a new not to exceed total of $12,721,188.65.

Summary:

Change Order No. 1 to the agreement is for the demolition of an existing wastewater system and the construction of a new wastewater system at Flowerwood Club Park Association, Inc. under Package 3.

 

Background/Explanation:

Various MHC’s wastewater systems are outdated and problematic. Many assets within these systems fail and pose costly risks to the residents and adverse effects to the environment. Improvements made to the wastewater systems of these flood-prone communities would increase the reliability of service during typical conditions and increase the resilience during wet weather events.

 

Fiscal Impact:

Total not to exceed: $12,721,188.65

All ARPA funds for this project have been encumbered for previously awarded MHCs. Estimated savings identified by Cathcart indicate that there will be sufficient ARPA funds remaining to complete the Flowerwood MHC. ARPA funds will be unencumbered from the Holiday Shores MHC, then encumbered for the Flowerwood MHC, and additional Resilient Florida funds will be added to the Holiday Shores MHC. After the addition of the Flowerwood MHC, based on Cathcart’s estimated savings, there will be $2,070,324.64 in ARPA funds remaining to be reallocated.

ARPA funding must be fully expended by December 31, 2026, and $25,000,000 in Florida Resilient funding must be fully expended by September 30, 2026. ARPA funds will be utilized for the Flowerwood MHC because it allows an additional six months to complete construction. 

 

Delegated Authority:

Authority for the County Administrator to approve and execute this change order is granted under Code Section 2-62(a)(1) for a reallocation of funding only from Package 2 MHC to Package 3 MHC with the same contractor at the original bid pricing.
