Recommended Action

Approval and execution by the County Administrator of the Interlocal Agreement (Agreement) with Florida Department of Transportation (FDOT) for the Florida Department of Environmental Protection (FDEP) Annual Regulatory Program and Surveillance Fee.

•                     FDOT is a National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) co-permittee and contributes $1,875.00 to the Annual Regulatory Program and Surveillance Fee.

•                     The Agreement between the County and FDOT will be in effect through December 31, 2027.

•                     The County and twenty-one municipal co-permittees also cost share the Annual Fee based upon jurisdictional population retrieved from the Bureau of Economic and Business Research. A separate Interlocal Agreement between these municipalities and NPDES for the FDEP Annual Regulatory Program and Surveillance Fee was executed November 30, 2021 (Legistar item 21-1145D).

County will pay the total annual fee of $30,299 and will be reimbursed approximately sixty-one (61%) percent by FDOT and the twenty-one co-permittees on an annual basis.  Thus, the County’s annual fee is $11,085.36 and the five-year total is $55,426.80.

Summary:

This Agreement is required by Chapter 62-624, F.A.C. for the County and the FDOT to continue to cost share the State required Annual Regulatory Program and Surveillance Fee. This process has been in place without an agreement since 1997. The Agreement will affirm this action and will remain in effect through December 31, 2027.

Background/Explanation:

The County’s NPDES Permit issued by FDEP, requires an Interlocal Agreement for all cost-sharing of the annual fee for the program. This is the first formal Agreement, although annual payments and reimbursements have occurred since program inception in 1997. The County implements the Regulatory Program and cost shares it with the twenty-one (21) municipal co-permittee’s (executed under Legistar item 21-1145D) and FDOT. Legistar item 21-1426D was the original agreement approved by County, however FDOT has requested edits, which is the reason for this current Legistar item. The related item is included here for reference under the associations tab.
