Approval of the petition by Ross and Tracey Patton to vacate the portion of a public drainage and utility easement located on the property at 8639 Maidstone Court, Seminole, Florida.

 

                     Request is for the vacation of the portion of a platted easement that is located on the petitioner’s property.

                     The request will allow the property owner to demolish the existing pool deck and pool and replace with a new deck and pool.

                     Staff recommends approval with the condition that Pinellas County is granted a new Utility and Drainage Easement that runs through the rear of the property.

                     If the petition is granted, the Board of County Commissioners is asked to adopt the attached Resolution pursuant to Florida State Statute §177.101.

 

Authorize the Clerk of the Circuit Court to record the resolution in the public records of Pinellas County.

Summary

This request is to vacate the portion of a 10-Foot wide Public Drainage and Utility that is located in the petitioner’s backyard. The petitioners are seeking to develop the area with a new pool and deck that would encroach into the easement. County staff is supportive of the vacation subject to a new easement being placed north of the pool, on the subject property. This easement is needed to keep the connection with the easement that is located on adjacent properties and is part of the subdivision drainage network. The petitioners have agreed to the new proposed Drainage and Utility easement.

Background Information:

County staff reviewed the request pursuant to Pinellas County Land Development Code Section 154-272, Criteria for Consideration, and have no objections to the vacation request.

The petition was properly advertised in accordance with Florida State Statute 177.101. Notices were mailed by the Clerk of the Court to property owners within 250 feet of the subject property. The Deputy Clerk will report to the Board any citizen support or opposition.

Letters of no objection were received from Duke Energy, TECO Gas, TECO Electric, Frontier, Charter/Spectrum and WOW!.
