Recommended Action

Approve the Drainage Easement Agreement for Pinellas Affordable Living, Inc’s Founder’s Point project. The execution of the Agreement acknowledges that the Mortgage shall be subject to the stated terms.

 

                     The County as lender, has a leasehold interest in the property.

                     The drainage easement area on the Founder’s Point site is part of the property included in that leasehold interest.

                     This Agreement will provide the City of St. Petersburg with the consent to the Perpetual and Non-Exclusive Public Drainage Easement.

                     The current request has no fiscal impact; Funding for this project was provided in Fiscal Year 2024 in the amount of $665,816.00 of HOME-ARP funding from the Housing and Community Development Department (Granicus file #23-1109A).

Summary:

The approval of the Agreement will ensure that Founder’s Point site provides the required drainage access as requested by the City of St. Petersburg.

 

Background/Explanation:

The execution of the Agreement is necessary, as lender with a leasehold interest in the property, to ensure drainage access within and for the City of St. Petersburg.

 

Fiscal Impact:

Funding for this agreement was provided in FY24 budget within Fund 1009 and does not impact the current FY25 budget within Fund 1009.

 

Delegated Authority:

Authority for the County Administrator to sign this Easement Agreement is granted by Board Action on August 15, 2023, agenda item #23-1109A.
