Approval of the sole-source agreement with Premier Magnesia LLC for magnesium hydroxide and equipment services.

 

                     This one-year contract provides an all-inclusive odor and corrosion control program utilizing magnesium hydroxide to the Utilities Department on an as-needed basis.

                     Total estimated expenditure for one year in the amount of $1,664,740.00.

                     Notice of intent to sole source was advertised on July 1, 2025, in accordance with Florida Statute 287.057(3)(a)(c). No responsive, responsible bidders were identified that met the advertised criteria.

                     Premier Magnesia is the only vendor that provides Thioguard®, a proprietary magnesium hydroxide blend, and all necessary equipment, maintenance, and support.

                     This agreement replaces a previous agreement with Premier Magnesia LLC, awarded by the Board of County Commissioners on October 20, 2020.

                     This request is budgeted for in the Fiscal Year 2026 Budget of the Utilities Department in the Sewer Revenue and Operating Fund.

 

Contract 25-0590-SS in the total not-to-exceed amount of $1,664,740.00 effective for one year upon execution; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary

The Utilities Department requires a firm to supply magnesium hydroxide as an odor control mechanism along with all the ancillary equipment necessary for the injection of the chemical. While other vendors do sell magnesium hydroxide, Premier Magnesia is the only vendor that provides Thioguard®, a proprietary magnesium hydroxide blend, and all necessary equipment, maintenance, and support. Purchasing the equipment separately would be costly both from an acquisition and maintenance perspective.

Contract pricing remains unchanged for this one (1) year term.

Staff is drafting requirements for a bid to be released/awarded prior to contract expiration.

Background Information:

On July 1, 2025, the Purchasing Department, on behalf of the Utilities Department, advertised an intent to sole source to identify competitive sourcing capable of providing an all-inclusive, turnkey odor and corrosion control program utilizing Thioguard®. No responsible, responsive vendors were identified. This contract replaces a current contract that expires on October 19, 2025.

 

Fiscal Impact:

Contract expenditure not to exceed:                     $1,664,740.00

 

This request is budgeted for in the FY26 Budget of PCU in the Sewer Revenue and Operating Fund.
