Approval and execution by the County Administrator of the Second Amendment to the Community Development Block Grant (CDBG) Program Subaward Land Use Restriction and Subrecipient Agreement (Agreement) with WestCare Gulfcoast - Florida, Inc. (WestCare), for CDBG funded facility improvements.
• This Second Amendment extends the term of Agreement CD24WCMS three (3) months to June 30, 2026, to provide additional time for project completion due to unforeseen delays in the permitting process.
• This Second Amendment also extends the term of the Restricted Period three (3) months, restricting the use of the property to serving homeless adults recovering from alcohol, drug abuse and/or mental illness, until July 1, 2032.
• The funding amount, not to exceed $54,173.00 during the term of the Agreement, remains unchanged.
• On April 25, 2025, the County Administrator executed CDBG Agreement CD24WCMS providing CDBG funding to WestCare for costs associated with facility improvements including the replacement of the roof at WestCare’s Mustard Seed Inn facility, located at 2510 Central Avenue, St. Petersburg, FL 33712, benefiting approximately 70 homeless adults recovering from alcohol, drug abuse and/or mental illness.
• On August 26, 2025, the County executed a First Amendment to CD24WCMS extending the term of the Agreement six (6) months to March 31, 2026, and extending the term of the Restricted Period six (6) months to April 1, 2032.
• The Agreement is effective for 21 months, from October 1, 2024, to June 30, 2026, with the land use restriction expiring on July 1, 2032.
• Authority for the County Administrator to sign this Amendment is granted under Code Section 2-62 (a)(1) and Resolution No. 24-46.

Summary:
This Second Amendment to CDBG Agreement CD24WCMS extends the term of Agreement three (3) months to allow for project completion and extends the term of the Restricted Period.
Agreement CD24WCMS requires that performance be completed by March 31, 2026. WestCare is unable to complete the project before the expiration date. It is necessary to extend the term of the Agreement three (3) months to June 30, 2026, to provide additional time for project completion. As a result of the term extension, it is necessary to extend the term of the Restricted Period three (3) months to July 1, 2032, restricting the use of the property to serving homeless adults recovering from alcohol, drug abuse and/or mental illness.
The extension to the restriction will be in the form of a Second Amendment to the Declaration of Restrictions, Exhibit 1, to be executed by WestCare and returned to the County with the executed Second Amendment. The restriction does not require County execution; however, the Second Amendment to the Declaration of Restrictions will be recorded in Official Records simultaneously with the Second Amendment to the Agreement.
The Agreement is effective for 21 months, from October 1, 2024, to June 30, 2026, with the land use restriction expiring on July 1, 2032.
Background/Explanation:
At the July 30, 2024, Board of County Commissioners (Board) meeting, the Board approved agenda item #43 (Granicus #24-1067A), Resolution No. 24-46, which approved the Fiscal Year 2024-2025 (FY25) Action Plan and authorized the Chairman, or designee, to sign Specific Performance Agreement, including amendments.
The WestCare Gulfcoast - Florida Mustard Seed Facility Rehabilitation Project was approved as a facility rehabilitation activity in the Action Plan.
On April 25, 2025, the County Administrator executed CDBG Agreement CD24WCMS providing CDBG funding to WestCare for costs associated with facility improvements including the replacement of the roof at WestCare’s Mustard Seed Inn facility, located at 2510 Central Avenue, St. Petersburg, FL 33712, benefiting approximately 70 homeless adults recovering from alcohol, drug abuse and/or mental illness.
The Agreement was effective October 1, 2024, through September 30, 2025, with the land use restriction expiring on October 1, 2031.
On August 26, 2025, the County executed a First Amendment to CD24WCMS extending the term of the Agreement six (6) months to March 31, 2026, and extending the term of the Restricted Period six (6) months to April 1, 2032.
Fiscal Impact:
The total amount of funding for this Agreement is not to exceed $54,173.00 during the term of the Agreement. Funding for this Agreement is included in the County’s Fiscal Year 2026 (FY26) Adopted Budget for CDBG funds within HCD.
Delegated Authority:
Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62 (a)(1) and Resolution No. 24-46.
