• Request is for the vacation of a portion of an easement located on the petitioner’s property.
• The request will allow the property owner to build a screen room addition.
• Staff recommends approval with the condition that encroachments within the remaining easement area are removed.
• If the petition is granted, the Board of County Commissioners is asked to adopt the attached resolution pursuant to Florida State Statute §177.101.
Authorize the Clerk of the Circuit Court to record the resolution in the public records of Pinellas County.

The purpose of the request is to vacate a 10-foot wide by 70-foot long portion of the 70-foot wide drainage easement located in the rear yard of the petitioner’s property. The petitioners are seeking to develop the area with a screen porch addition to their home. The encroachments within the remaining easement area will be removed. The adjacent neighbors to the subject property received similar vacations previously. This property, for reasons unknown, was excluded from Resolution 84-587 in which adjacent neighbors vacated the 10 feet of the 70-foot drainage easement.

Background Information:
County staff reviewed the request pursuant to Pinellas County Land Development Code Section 154-272, Criteria for Consideration, and have no objections to the vacation request. The petition was properly advertised in accordance with Florida State Statute 177.101. Notices were mailed by the Clerk of the Court to property owners within 250 feet of the subject property. The Deputy Clerk will report to the Board any citizen support or opposition.
Letters of no objection were received from Duke Energy, TECO Gas, TECO Electric, Frontier, Charter/Spectrum and WOW!

$750.00 has been received as a Petition Fee from the Petitioner for this request.
