Approval and execution by the County Administrator of the First Amendment to the Community Development Block Grant (CDBG) Program Subaward Land Use Restriction and Subrecipient Agreement (Agreement) with the City of Tarpon Springs (City), for CDBG funded facility improvements.
• This First Amendment extends the term of Agreement CD24TSCC three (3) months to December 31, 2025, to provide additional time for project completion due to unforeseen delays in obtaining project materials and in the permitting process.
• This First Amendment also extends the term of the Restricted Period three (3) months to January 1, 2033, restricting the use of the property to providing services to the residents of the community, until January 1, 2033.
• This First Amendment also updates the Federal Award Date, which was unknown at the time the Agreement was initially executed.
• The funding amount, not to exceed $90,000.00 during the term of the Agreement, remains unchanged.
• On October 23, 2024, the County Administrator executed CDBG Agreement CD24TSCC providing CDBG funding to the City for costs associated with facility improvements including repaving the parking lot and replacing the facility’s sign at the City’s Community Center, located at 400 South Walton Avenue, Tarpon Springs, FL 34689, within the locally designated Tarpon Springs Target Area, a low- and moderate-income area, benefitting approximately 2,735 low- and moderate-income residents.
• The Agreement was effective October 1, 2024, through September 30, 2025, with the land use restriction expiring on October 1, 2032.
• Authority for the County Administrator to sign this Amendment is granted under Code Section 2-62 (a)(1) and Resolution No. 24-46.Body

Summary:
This First Amendment to the CDBG Program Subaward Land Use Restriction and Subrecipient Agreement CD24TSCC extends the term of the Agreement three (3) months to allow for project completion, extends the term of the Restricted Period, and updates the Federal Award Date.
The Agreement requires that performance be completed by September 30, 2025. The City is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement three (3) months to December 31, 2025, as additional time is required for the completion of the project. As a result of the term extension, it is necessary to extend the term of the Restricted Period three (3) months to January 1, 2033, restricting the use of the property to serving the residents of the community.
Additionally, when the Agreement was initially executed, the County had not yet received an executed grant agreement from the U.S. Department of Housing and Urban Development. The Agreement is being updated to include the Federal Award Date identified on the grant agreement.
Background/Explanation:
At the July 30, 2024, Board of County Commissioners (Board) meeting, the Board approved agenda item #43 (Granicus #24-1067A), Resolution No. 24-46, which approved the Fiscal Year 2024-2025 (FY25) Action Plan and authorized the Chairman, or designee, to sign Specific Performance and Land Use Restriction Agreements, including amendments.
The City Community Center Improvement Project was approved as a facility rehabilitation activity in the Action Plan.

Fiscal Impact:
The total amount of funding for this agreement is not to exceed $140,500.00 during the term of the Agreement. Funding for this Agreement is included in the County’s FY25 Adopted Budget for CDBG funds within Housing and Community Development (HCD).

Authority for the County Administrator to sign this Amendment is granted under (Code Section 2-62 (a)(1) and Resolution No. 24-46.
