Recommended Action:

Recommended Action

Approval and execution by the County Administrator of the Interlocal Agreement (Agreement) with Florida Department of Transportation (FDOT) for the Florida Department of Environmental Protection Annual Regulatory Program and Surveillance Fee.

•                     This Agreement is necessary for the County and the FDOT to continue to implement the regulatory program and cost-share the State-required fee.

•                     FDOT is a National Pollutant Discharge Elimination System Municipal Separate Storm Sewer System (MS4) co-permittee and contributes to the Annual Regulatory Program and Surveillance Fee based on a flat contribution of $1,875 per Chapter 62-624, F.A.C.

•                     County and twenty-one (21) municipal co-permittee’s also cost share the Annual Fee based upon jurisdictional population retrieved from the Bureau of Economic and Business Research. A separate Interlocal Agreement is to be signed by end of CY 2021 (Legistar item 21-1145D).

•                     The Agreement identifies the cost-sharing structure as established in previous years. The Annual Fee has been paid via cost-share since inception of the program (1997) without a formal Agreement in place.

•                     Agreement will be in effect through December 31, 2026.

Summary:

This Agreement is required by Chapter 62-624, F.A.C. for the County and the FDOT to continue to cost-share the State required Annual Regulatory Program and Surveillance Fee. This process has been in place without an agreement since 1997, and is included in the annual Department budget. The Agreement will affirm this action and will remain in effect through December 31, 2026.

Background/Explanation:

The County’s MS4 NPDES Permit issued by FDEP, now requires an Interlocal Agreement for all cost-sharing of the annual fee for the program. The County implements the Regulatory Program and cost shares it with the twenty-one (21) municipal co-permittee’s and FDOT. This is the first documented Agreement to date, although annual payments and reimbursements have occurred since program inception in 1997.

Fiscal Impact:

County will pay the total annual fee ($30,299) and will be reimbursed approximately sixty-one (61%) percent by the FDOT and the twenty-one (21) co-permittees on an annual basis based on population retrieved from the Bureau of Economic and Business Research as follows:
