Approval and execution by the County Administrator of the First Amendment to the Community Development Block Grant (CDBG) Program Subaward Land Use Restriction and Subrecipient Agreement (Agreement) with Homeless Emergency Project, Inc. d/b/a Homeless Empowerment Program (HEP), for CDBG funded facility improvements.
• This First Amendment extends the term of Agreement CD24HEP six (6) months to March 31, 2026, to provide additional time for project completion due to unforeseen delays in the permitting process and extends the term of the Restricted Period six (6) months to April 1, 2036, restricting the use of the property to serving the homeless, until April 1, 2036.
• The funding amount, not to exceed $140,500.00 during the term of the Agreement, remains unchanged.
• On December 13, 2024, the County Administrator executed CDBG Agreement CD24HEP providing CDBG funding to HEP for costs associated with facility improvements including replacing the roof, siding, windows, doors, and stairwell and site preparation, landscaping, irrigation and crawlspace ventilation at HEP’s Family Transition Program Shelter, located at 1277 Otis C. Green Drive, Clearwater, FL 33755, benefitting approximately 125 homeless individuals.
• The Agreement is effective October 1, 2024, through September 30, 2025, with the land use restriction expiring on April 1, 2036.
• Authority for the County Administrator to sign this Amendment is granted under Code Section 2-62 (a)(1) and Resolution No. 24-46.

Summary:
This First Amendment to the CDBG Program Subaward Land Use Restriction and Subrecipient Agreement CD24HEP extends the term of the Agreement six (6) months to allow for project completion and extends the term of the Restricted Period.
The Agreement requires that performance be completed by September 30, 2025. HEP is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement six (6) months to March 31, 2026, as additional time is required for the completion of the project. As a result of the term extension, it is necessary to extend the term of the Restricted Period six (6) months to April 1, 2036, restricting the use of the property to serving the homeless.
Background/Explanation:
At the July 30, 2024, Board meeting, the Board approved agenda item #43 (Granicus #24-1067A), Resolution No. 24-46, which approved the 2024-2025 (FY25) Action Plan and authorized the Chairman, or designee, to sign Specific Performance and Land Use Restriction Agreements, including amendments.
The HEP Family Transition Shelter Rehabilitation project was approved as a facility rehabilitation activity in the Action Plan.

Fiscal Impact:
The total amount of funding for this agreement is not to exceed $140,500.00 during the term of the Agreement. Funding for this Agreement is included in the County’s FY25 Adopted Budget for CDBG funds within HCD.
