Summary:

The primary purpose of this agreement is for FDOT to reimburse the County for O&M costs associated with the Lake Seminole Alum Facilities.  The FDOT estimates their contributing drainage area to Lake Seminole is 2.13%.  The County estimates the annual cost of operating and maintaining Lake Seminole Alum Treatment Facilities to be $180,242.00.  Notwithstanding these estimates, the annual cost to FDOT shall be limited to the lesser of (a) 2.13% of the annual, actual, full O&M costs, estimated to be $3,839.15; or (b) $10,000.00.

Background/Explanation:

The original agreement with FDOT provided for reimbursement of Lake Seminole Alum Facility annual O&M costs for a five year term and was approved on April 27, 2009.  Amendment No. 1 extended the original agreement end date to April 27, 2019.  Amendment No. 2 provided for FDOT to encumber additional funds for reimbursement of O&M costs.  This new agreement incorporates updated terms and conditions for payment request procedures, and a detailed cost allocation method.  Upon full execution, the new agreement will supersede and replace the prior agreement.

Fiscal Impact:

The FDOT will reimburse the County 2.13% of the actual annual O&M costs estimated to be $3,839.15, or $10,000 annually, whichever is less, over a five year period.  Funding to support County’s annual O&M costs of $180,242.00, and the anticipated revenue, is included in the FY19 Adopted Budget and FY20 budget request within the Surface Water Assessment Fund.

Delegated Authority:

Authority for the County Administrator to sign this agreement is granted under Code Section 2-62 (a)(1).
