Approval and execution by the County Administrator of the First Amendment to the Community Development Block Grant (CDBG) Program Subaward Land Use Restriction and Subrecipient Agreement (Agreement) with PARC Housing II, Inc. (PARC), for CDBG funded facility improvements at the Burkett Villas Group Home.
• This First Amendment extends the term of Agreement CD24PARCBV three (3) months to December 31, 2025, to provide additional time for project completion due to unforeseen delays in obtaining project materials and in the permitting process.
• This First Amendment also extends the term of the Restricted Period three (3) months to January 1, 2033, restricting the use of the property to providing services to low-and moderate-income adults with intellectual and developmental disabilities until January 1, 2033.
• The funding amount, not to exceed $88,791.00, during the term of the Agreement, remains unchanged.
• On December 11, 2024, the County Administrator executed CDBG Agreement CD24PARCBV providing CDBG funding for costs associated with the purchase and installation of a generator and a concrete generator pad at PARC’s Burkett Villas Group Home, located at 5353 - 31st Street North, St. Petersburg, FL 33714, benefitting approximately 15 individuals with intellectual and developmental disabilities.
• The Agreement is effective for one (1) year, from October 1, 2024, through September 30, 2025, with the land use restriction expiring on October 1, 2032.
• Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62 (a) (1) and Resolution No. 24-46.Body

Summary:
This First Amendment to the CDBG Program Subaward Land Use Restriction and Subrecipient Agreement CD24PARCBV extends the term of the Agreement three (3) months to allow for project completion and extends the term of the Restricted Period.
The Agreement requires that performance be completed by September 30, 2025. PARC is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement three (3) months to December 31, 2025, as additional time is required for the completion of the project. As a result of the term extension, it is necessary to extend the term of the Restricted Period three (3) months to January 1, 2033, restricting the use of the property to serving individuals with intellectual and developmental disabilities until January 1, 2033.
Background/Explanation:
At the July 30, 2024, Board of County Commissioners (Board) meeting, the Board approved agenda item #43 (Granicus #24-1067A), Resolution No. 24-46, which approved the Fiscal Year 2024-2025 (FY25) Action Plan and authorized the Chairman, or designee, to sign Specific Performance and Land Use Restriction Agreements, including amendments.
The PARC Burkett Villas Facility Rehabilitation project was approved as a facility rehabilitation activity in the Action Plan.

Fiscal Impact:
The total amount of funding for this Agreement is not to exceed $88,791.00 during the term of the Agreement. Funding for this Agreement is included in the County’s FY25 Adopted Budget for CDBG funds within HCD.
