Approval for the construction of the Manufactured Home Communities (MHC) Wastewater Collection Systems Improvements American Rescue Plan Act Project - Package 3 for Flowerwood Club Park Association, Inc. of Contract No. 24-0421-ITB-C.
• Agreement is for decommissioning and construction of a new wastewater system at Flowerwood Club Park Association, Inc. as part of MHC Wastewater Collection Systems Improvements Project - Package 3.
• County requests Board of County Commissioners approve the Agreement to proceed with construction. Work is anticipated to begin in December 2025.
• Total construction cost is estimated at $3,363,957.55. Savings from the original grant award has been identified that allows Flowerwood to be added to project.
• Park was recently approached and asked if they still wanted to pursue project. Agreement was resigned two weeks ago by the Homeowners Association President.
• Funding for construction is available under Manufactured Home Communities Wastewater Collection System Improvements project 005015A, included in the Fiscal Year (FY) 2026-FY31 Capital Improvement Plan, funded by the American Rescue Plan Act Fund, in the amount of $5,434,283.19.
The County will record the agreement in its entirety including Attachments A and B; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary
The original scope of the project included 13 MHCs. An agreement between County and the MHCs was signed by each MHC in May 2024, and design work was completed for all 13 MHCs, including Flowerwood Club Park Association, Inc. However, due to limitations in grant funding, only seven communities received construction contracts during the initial phase. Flowerwood Club Park Association, Inc. was not among those selected. During construction, savings has been identified that allows the Flowerwood Club Park Ass. to be added to the project. County has since identified additional grant funds to support the completion of wastewater system improvements for Flowerwood Club Park Association, Inc. The total construction cost is estimated at $3,363,957.55.

Manufactured Home Communities (MHCs) Wastewater Collection Systems Improvements Project - Package 3 includes Bel-Aire Mobile Homeowners, Inc. and Tropical Gardens Resident Owned Community, Inc. currently under construction.
Considering this process with Flowerwood started eighteen months ago, the Park was recently approached and asked if they still wanted to pursue the project. The Agreement was resigned two weeks ago by the Homeowners Association President.
An authorized signer for the Community will execute the Temporary Construction Easement, attached as Attachment A, in conjunction with the execution of this Agreement. The Community will return the executed Temporary Construction Easement to the County, and County will record it upon receipt, at which time this Agreement in its entirety will be recorded and available in the public records in association.
Upon completion of the project, the County will provide the Community with a perpetual Utility Easement in the form of Attachment B, prepared by County and incorporating the survey of the completed project. The Community will, as soon as reasonably possible after receipt, execute the easement, by notarized signature of an authorized signer with two witnesses. The Community will return the executed easement to the County, and County will record the perpetual Utility Easement upon receipt.

Background Information:
Many wastewater systems within various Manufactured Home Communities (MHCs) are outdated and increasingly problematic. Aging infrastructure and frequent asset failures pose significant financial risks to residents and contribute to environmental degradation. Upgrading these systems-particularly in flood-prone areas-will enhance service reliability under normal conditions and improve resilience during wet weather events.
The Purchasing Division issued an invitation to bid on April 23, 2024. Two submittals were received with award recommendation to Cathcart, as the lowest responsive and responsible bidder.
Fiscal Impact:
Funding for construction is available under Manufactured Home Communities Wastewater Collection System Improvements project 005015A, included in the FY26-FY31 Capital Improvement Plan, funded by the American Rescue Plan Act Fund, in the amount of $5,434,283.19.
This agreement accompanies 25-0939D and 25-0940D, amending package 2 and package 3 to include the Flowerwood community at the originally bid price of $3,363,957.55. There is no net increase to the contract values. The cost of the Flowerwood community will be covered by savings realized during construction of the previous communities.
