Approval of the First Amendment (Amendment) to the Agreement with S&ME, Inc. for requirements of continuing environmental and engineering consulting services including environmental assessment and remediation activities.
• Amendment increases contract limit from $500,000.00 to $920,000.00 to continue remediation at the former Zero Corporation site.
• Environmental assessment and remediation services are on a task order basis.
• For consistency with maintenance, operations and interactions with the Florida Department of Environmental Protection, it is best to retain the existing consultant services firm.
• The County assumed remediation responsibility of the former Zero Corporation site, when the company filed bankruptcy and dissolved in 2007.
• Project is budgeted and funding derived through several Capital Improvement Program budgets and/or operating budgets based on task order assignments.
Contract no. 156-0008-CN (RG); increase in the not to exceed amount of $420,000.00 for a revised five year upset limit of $920,000.00; effective through April 8, 2021. Authorize the Chairman to sign and the Clerk of the Court to attest.

Summary:
This Amendment increases the contract upset limit for S&ME from $500,000 to $920,000.00, in order to continue the operation and maintenance of the remediation system and groundwater monitoring at the Zero site (14501 49th Street N., Clearwater), under the consistent guidance of the same consultant, for the remainder of the contract term. S&ME has been successfully operating the remediation equipment for the past 3 years, conducting quarterly monitoring, well sampling and producing the annual report required by the Florida Department of Environmental Protection (FDEP).
Background Information:
Metal products for military and commercial use were fabricated at the former Zero Corporation site from 1970 through 1990. Metal degreasing activities were conducted at the site and degreasing solvents were released into the subsurface during operation of the facility, impacting soil and groundwater quality at the site. The facility was shut down in March 1990, and the associated structures were demolished and removed in 1998. The Zero Corporation filed for bankruptcy in 2007. Since then, the County has assumed responsibility for the environmental restoration of the site.
This contract was originally approved by the Board of County Commissioners on August 9, 2016 and provides for environmental and engineering consulting services on as needed basis. The contract was awarded to five (5) different firms with a not to exceed upset limit of $500,000 over the five (5) year term of the contract for each firm.
Fiscal Impact:
Original S&ME Approved upset limit not to exceed $500,000.00
Increase not to exceed $420,000.00
Revised S&ME five (5) year upset limit not to exceed $920,000.00
Funding is derived through various Capital Improvement Program budgets and/or operating budgets per individual work assignments on a multiple year/multiple work assignment basis.
