Approval and execution by the County Administrator for termination of Cooperative Funding Initiative (CFI) Agreement with the Southwest Florida Water Management District (SWFWMD) for construction of the Roosevelt Creek Channel 5 Improvements project.
• Agreement provided for SWFWMD to contribute up to $357,571.00 toward the total construction cost of this project.
• County was unable to award the project due to lowest construction bid exceeding the engineer’s estimate by 86%.
• County Administrator approved rejection of bids on April 21, 2020.
• The County plans to rebid the project following modifications to the specifications and engineering cost estimate.
• A new agreement with SWFWMD will be required for any new bid award and construction contract. In anticipation, the County has included the project in our FY 2022 Cooperative Funding Initiative with SWFWMD for cost sharing.

Summary:
This termination cancels the Agreement with SWFWMD for cooperative funding assistance on the Roosevelt Creek Channel 5 Improvements project. On April 21, 2020, the County Administrator approved the rejection of bids received for the project due to the lowest responsive and responsible bid exceeding the engineer’s cost estimate by eighty-six percent (86%). The County and SWFWMD did not finalize records for the termination of the Fiscal Year (FY) 2020 grant at that time.
Background/Explanation:
The Roosevelt Creek Channel 5 Improvements project provides several benefits including improved flood protection level of service, restoration of natural hydrologic flow, removal of exotic vegetative species and re-establishment of native plant species, bank stabilization, and other stormwater infrastructure improvements.
In 2019, the Roosevelt Creek Channel 5 improvements project was bid as Project ID 002123A. The lowest responsive and responsible bid was rejected as it exceeded the engineer’s cost estimate for the scope of work by 86%. Since the County was unable to award and construct the project within the term of the agreement, records for termination of the agreement need to be finalized.
An agreement for SWFWMD CFI funding of this project in the amount of $350,000 is anticipated to be finalized in the first quarter of FY 2022. The project will be re-bid, and construction is anticipated to begin in FY 2022.
Fiscal Impact:
Project 002123A - Roosevelt Creek Channel 5 Improvements is included in the Capital Improvement Program FY22-FY27 Six-Year Plan in the Physical Environment Function, Flood Control Projects Program. This Six-Year Plan reflects the anticipated $350,000.00 SWFWMD funding.
