Approval and execution by the County Administrator of a Contract for Sale and Purchase of Easement with K Sixty Seven LLC (Owner) to purchase a temporary construction easement over Owner’s property at the SE corner of 7th Avenue North and 6th Street West, Tierra Verde.
• In support of County Utilities’ Pass-a-Grille to Tierra Verde Water Main Replacement Project, the County is requesting a temporary construction easement over Owner’s property (parcel #19-32-16-90900-012-0180) for the laydown and storage of equipment and parking, for a period of 6 months.
• The negotiated purchase price for the easement is $30,000.
• Funding for the acquisition is available under Pass-a-Grille to Tierra Verde Water Main Replacement project 006423A, included in the FY26-FY31 Capital Improvement Program, funded by the Water Renewal and Replacement Fund in the amount of $3,498,000.00, contingent on BCC approval of the FY26 Carry-forward Amendment.

Summary:
Approval and execution of the Contract for Sale and Purchase will allow the County to acquire a temporary construction easement over Owner’s property, in support of the County’s Pass-a-Grille to Tierra Verde Water Main Replacement Project.
Background/Explanation:
County Utilities is replacing a leaking subaqueous water main between 9th Avenue in Pass-a-Grille and 6th Street West in Tierra Verde.
Utilities requested a Temporary Construction Easement (TCE) over Owner’s property, for the laydown and storage of equipment. The TCE will avoid having to use adjoining right-of-way, which could potentially require temporarily closing streets during construction, thereby disrupting traffic flow.
Fiscal Impact:
Purchase price for the easement is $30,000, plus nominal recording costs to record the TCE in the Public Records.
Funding for the acquisition is available under Pass-a-Grille to Tierra Verde Water Main Replacement project 006423A, included in the Capital Improvement Program, funded by the Water Renewal and Replacement Fund in the amount of $3,498,000.00, contingent on BCC approval of the FY26 Carry-forward Amendment. Funding in excess of the acquisition is available for other project costs including design, construction, and inspections.
