Approval of the First Amendment to the Community Development Block Grant (CDBG) Program Subaward Specific Performance and Land Use Restriction Agreement (First Amendment) with Community Action Stops Abuse, Inc. (CASA) for CDBG funded facility improvements.

 

                     This First Amendment revises the scope of the project to include architectural design plans for the project including installation of a secured automatic entry gate and second entrance and asphalt driveway at CASA’s domestic violence shelter.

                     This First Amendment also extends the term of Agreement CD21CASA three (3) months to December 31, 2022, to provide additional time for project completion, and extends the term of the Restricted Period three (3) months, to January 1, 2028.

                     The funding amount, not to exceed $42,504.00 during the term of the Agreement, remains unchanged.

                     On November 5, 2021, the County provided CDBG funding to CASA for costs associated with facility improvements at CASA’s domestic violence shelter, benefitting approximately 500 survivors of domestic violence and their children.

Summary:

This First Amendment to the CDBG First Amendment CD21CASA revises the scope of the project to allow for architectural design plans; extends the term of the Agreement three (3) months to allow for project completion and extends the term of the Restricted Period.

CASA experienced difficulties securing a general contractor for the improvements due to not having architectural plans for the project. CASA has requested that contracting for architectural design plans be incorporated into the scope of the project.

The Agreement requires that performance be completed by September 30, 2022. CASA is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement three (3) months to December 31, 2022. As a result of the term extension, it is necessary to extend the term of the Restricted Period three (3) months, restricting the use of the property to serving survivors of domestic violence and their children, to January 1, 2028.

 

Background/Explanation:

On July 13, 2021, the Board of County Commissioners (Board) executed Resolution No. 21-47, which approved the 2021-2022 (FY22) Action Plan. The CASA Facility Improvements project was approved as a facility rehabilitation activity in the Action Plan.

On November 5, 2021, the County Administrator executed CDBG Agreement CD21CASA, providing CDBG funding for improvements at CASA’s domestic violence shelter. The Agreement was effective October 1, 2021, through September 30, 2022, with the land use restriction expiring on October 1, 2027.

 

Fiscal Impact:

There is no fiscal impact. The total amount of funding for this project is not to exceed $42,504.00 during the term of the Agreement. Funding for this Agreement is consistent with the County’s FY22 Adopted Budget and is included in the Fiscal Year 2023 (FY23) Budget Request for CDBG funds.

 

Delegated Authority:

Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62(a)(1) and Resolution No. 21-47.
