Summary:
Summary
The national trend for the settlement of litigation arising from the opioid epidemic includes settlement with the states’ attorneys general for and on behalf of all local governments within the state. Pinellas County and three of its municipalities, Clearwater, Pinellas Park and St. Petersburg, are litigating plaintiffs in the National Prescription Opiate Litigation, MDL No. 2804 (N.D. Ohio), while the State is the litigating plaintiff in Circuit Court in Pasco County. The Florida Attorney General has proposed a Memorandum of Understanding (the Florida Plan) that governs the allocation and use of settlement proceeds and would enable the Attorney General to negotiate on behalf of all participants. The proposed resolution would authorize the County Administrator to execute agreements as may be necessary to approve participation in the Florida Plan, as well as the allocations and abatement priorities set forth therein. The resolution does not delegate any settlement approval to the County Administrator.
