Summary
On or about June 11, 2024, a Duke Energy power line broke and landed on the DMS #8927 superstructure where it remained energized, destroying the digital message sign (DMS) and electrical components connected to the mast arm super structure. As a result, Pinellas County suffered damage in excess of $100,000.00.
Once brought to Risk Management’s attention, Risk Management made a claim with Duke and its insurer. The matter remained under investigation at the time the two-year statute of limitations was to run and, as a result, the County Attorney’s office filed litigation with the approval of the Chairman, to preserve the County’s claim.
This item is now being brought to the County Commission for ratification, consistent with Resolution No. 21-23.
This item seeks ratification of litigation against Duke Energy Corp. and any related corporate entities arising from the June 11, 2024 incident.
