First Amendment to the Community Development Block Grant Program Subaward Specific Performance and Land Use Restriction Agreement with Boys & Girls Clubs of the Suncoast, Inc. for Community Development Block Grant funded facility improvements.
Recommended Action:
Approval and execution by the County Administrator of the First Amendment to the Community Development Block Grant Program Subaward Specific Performance and Land Use Restriction Agreement (First Amendment) with Boys & Girls Clubs of the Suncoast, Inc. (Boys & Girls Club) for Community Development Block Grant (CDBG) funded facility improvements.
• This First Amendment provides an additional $8,965.00 for costs related to additional electrical issues discovered since the initial funding request, for a total CDBG investment of $91,610.00.
• This First Amendment extends the term of the Agreement three months to December 31, 2022, providing additional time for project completion.
• This Amendment extends the term of the Restricted Period 15 months, restricting the use of the property through January 1, 2030.
• On November 12, 2021, the County provided $82,645.00 in CDBG funding to the Boys & Girls Club for costs associated with upgrading electrical systems and the replacement of exterior perimeter fencing and playground surfaces at the agency’s Tarpon Spring’s site located at 111 West Lime Street, Tarpon Springs, Florida 34689, benefitting approximately 160 low- and moderate-income Pinellas County youth.
• The Boys & Girls Clubs’ Tarpon Springs facility is located in the locally designated Tarpon Springs Target Area, a low- and moderate-income area.
• The Agreement is effective from October 1, 2021, to December 31, 2022. Use of the property is restricted to providing services to low- and moderate-income youth through January 1, 2030.

Summary:
The First Amendment will provide an additional $8,965.00 in CDBG funding, increasing the total CDBG investment to $91,610.00; will amend the project description to include necessary survey costs and allow for expanded exterior fencing installation; will provide additional time for completion of the project by extending the term of the Agreement to December 31, 2022; and will extend the term of the land use restriction period to January 1, 2030.
Due to the exclusion of the cost for a survey of the property and the added installation and/or replacement of exterior fencing and electrical upgrades from the initial proposals for the project, additional funding is required for project completion. The original cost for the project was, $82,645.00, with funding being provided by the County. The new cost of the project, based on the lowest bid received, is $91,610.00. The additional funding is to cover the cost difference.
The Agreement requires that performance be completed by September 30, 2022. The Boys & Girls Club is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement three (3) months, to December 31, 2022. As a result of the additional CDBG funding and the term extension, it is necessary to extend the term of the Restricted Period 15 months, restricting the use of the property to serving low- and moderate-income youth through January 1, 2030.
Background/Explanation
On July 13, 2021, the Board executed Resolution 21-47, which approved the 2021-2022 Action Plan. The Boys & Girls Club Tarpon Springs Facility Rehabilitation Project was approved as a facility rehabilitation activity in the 2021-2022 Action Plan.
On November 12, 2021, the County Administrator executed CDBG Agreement CD21BGCTS, providing CDBG funding for facility improvements at the Boys & Girls Club Tarpon Springs site. The Agreement was effective October 1, 2021, through September 30, 2022, with the land use restriction expiring on October 1, 2029.
Fiscal Impact:
The total amount of funding for this agreement is not to exceed $91,610.00 during the term of the Agreement. Funding for this Agreement is consistent with the County’s FY22 Adopted Budget for CDBG funds and is included in the FY22 Adopted Budget, the FY22 Estimate, and the FY23 Budget Request.

Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62 (a) (1).
