Approval and execution by the County Administrator of Change Order No. 1 Final to the agreement with Keystone Excavators, Inc. for water main improvements on Pass-A-Grille Way, and Gulf Way from 9th Avenue to 22nd Avenue and sanitary sewer system improvements on 62nd Street North.

 

                     This project was substantially completed on April 28, 2025, and obtained final completion on August 27, 2025. An additional 104 days were added from additional work authorizations. Liquidated damages do not apply as the county received substantial and beneficial use on April 28, 2025.

                     Final quantities have been tabulated resulting in a net decrease of ($237,228.18). This is a difference between estimated and final quantities and balance of unspecified work not used.

                     Final calculations have been confirmed by the Office of Management and Budget. Funding for this contract was available under Pass-a-Grille Way and Gulf Way from 9th Avenue to 22nd Avenue. Water Improvement Project 004573A, funding by Water Renewal and Replacement Fund, and 62nd Street North Force Main Extension and Gravity Main Capacity Improvement, funding by the Sewer Renewal and Replacement Fund.

 

Contract no. 23-0953-ITB-C, decrease the agreement amount by ($237,228.18), for a revised not-to-exceed contract amount of $3,352,876.82.

Summary:

The project was substantially completed on April 28, 2025, and obtained final completion on August 27, 2025. An additional 104 days were added due to additional work authorizations. Liquidated damages do not apply, as the county received substantial and beneficial use on April 28, 2025. Final inspections of the project for all work performed under the contract were conducted by representatives of the Public Works Construction Management Division. All work has been completed in accordance with the construction contract documents. The time between substantial and final completion accounts for the duration to complete the walk through inspection with project stakeholders, punch list items, final testing, project acceptance, receipt and approval of certified as-builts required, Engineer of Record (EOR) final acceptance and approval, final project deliverables, final quantity of materials audit, resolution of claims and disputes, and receipt of final Invoice.

Background/Explanation:

Construction improvements were completed to the County’s aging watermain infrastructure at Pass-A-Grille Way and Gulf Way from 9th Avenue to 22nd Avenue, improving the water quality circulation and providing additional public safety. The 62nd Street North Force Main Extension and Gravity Main Capacity Improvement increased capacity to the County’s sanitary sewer system to minimize potential sanitary sewer overflows.

The Board of County Commissioners awarded this contract on November 14, 2023, in the amount of $3,590,105.00.

 

Fiscal Impact:

Original Agreement Amount: $3,590,105.00

Decrease due to Change Order No. 1: ($237,228.18)

Revised Agreement Amount: $3,352,876.82

 

Final calculations have been confirmed by the Office of Management and Budget. A total of $3,352,876.82 was released from the agreement not-to-exceed amount of $3,590,105.00, leaving a balance of $237,228.18.

 

Funding for this contract was available under Pass-a-Grille Way and Gulf Way from 9th Avenue to 22nd Avenue Water Improvement Project 004573A, funded by the Water Renewal and Replacement Fund, and 62nd Street North Force Main Extension and Gravity Main Capacity Improvement, funded by the Sewer Renewal and Replacement Fund.

Authority for the County Administrator to sign this change order final is granted under Code Section 2-62(a)(3).
