Approval of the resolution designating job titles of potential Code Enforcement Officers or Inspectors.

 

                     Florida law authorizes designation of code enforcement officers for enforcement of county code violations.

                     Pinellas County has historically designated employees in code enforcement officer and inspector positions by resolution. The last update to the designated list was in 2010 and with the passage of time, an update is warranted.

                     Designated code enforcement officer employees are eligible under Florida law to be assigned a protected class designation for purposes of protecting their home addresses, telephone numbers, places of employment, dates of birth, photographs and those of their spouses and children, including day care facility address, from public record.

                     The resolution also directs Human Resources to assign these employees to a protected class designation.

The proposed resolution designates job titles which may be held by employees who are authorized to perform code enforcement duties.  Specific employees within the designated job titles may be designated by their department director and, once so designated, are expressly authorized to issue citations and initiate Special Magistrate hearings for local ordinance violations.  The resolution additionally provides flexibility for renaming of positions.

Background Information:

Florida law authorizes the designation of code enforcement officers for the enforcement of county code violations.  Resolution 10-198 was the most recent resolution in which the Board of County Commissioners (Board) designated Code Enforcement Officers under the County Administrator.  With the passage of time, job titles have changed, and new positions have been created warranting an update to the Board’s designation.  In addition to setting forth job titles which may have code enforcement responsibilities and requiring department directors to identify specific employees holding designated job titles who actually perform code enforcement duties, the resolution directs Human Resources to assign a protected class designation to these employees in OPUS, for purposes of Chapter 119, Florida Statutes.  Additionally, the County Administrator or his designee is delegated the authority to revise designated job titles in light of internal reorganization or rebranding.
