Approval of the Joint Project Agreement (JPA) with the City of Pinellas Park (City) for construction of a culvert replacement at the intersection of 102nd Avenue North and Cross Bayou Canal, in conjunction with the culvert and roadway replacement of 102nd Avenue North.

 

                     In conjunction with the City roadway and culvert replacement project, the County requested the existing culverts within the Cross Bayou Canal be replaced.

                     The Cross Bayou Canal culverts at 102 Avenue need replacement and there has been a long-standing request to upsize the culverts so the canal may be navigated by small, non-motorized boats that are supported by an existing City launch.

                     The JPA replaces a recently expired JPA for the same project. City utility relocations took longer than expected.  The JPA has not materially changed.

                     County agrees to pay a not to exceed amount of $710,000.00 for construction, in addition to the $62,952.85 that was previously paid by the County for design under the original JPA.

                     Project 004473A -102nd Avenue North Culvert JPA Pinellas Park is a sub-project of budgeted project 003800A - Flood Prevention Program. The Flood Prevention Program project is funded by Local Infrastructure Sales Surtax (Penny for Pinellas).

                     The County’s anticipated contribution of $710,000.00, towards construction, is included in the Fiscal Year 2023 budget for project 003800A - Flood Prevention Program.

 

PID No. 004473A; County to pay City $710,000.00, for construction, as part of the Agreement; Agreement term will expire upon completion of project; Authorize the Chairman to sign and the Clerk of the Circuit Court to attest.

Summary

Pinellas Park will be constructing roadway and culvert improvements on 102nd Avenue North at the City’s Public Works Yard, west of 66th Street. The 102nd Avenue North roadway crosses the Cross Bayou Canal, and existing culverts do not allow for recreational boat passage from south to north of 102nd Avenue North. At the County’s request, part of the improvements will include resized culverts to address navigability.

The City and the County entered a previous JPA on June 23, 2020. The Agreement expired on June 13, 2022. The City advertised the culvert and roadway replacement of 102nd Avenue North at the Cross Bayou Canal and received three (3) bids. The lowest bid was for $1,689,857.07. As part of a new JPA, the County agrees to contribute $710,000.00 to the City’s roadway and culvert replacement project of 102nd Avenue North at the Cross Bayou Canal.

The JPA, in the amount of $710,000.00, replaces the recently expired agreement. The City is agreeable, at County request, to enlarging the culvert provided the County contributes to the Project cost. As part of the original Agreement, the County agreed to pay up to 50% of Project design costs. If the City fails to issue a Notice to Proceed for Project construction by May 1, 2023, this Agreement shall terminate, and the $62,952.85 payment made by the County to the City under the Original Agreement for project design shall be refunded in full by the City within thirty (30) days.

Background Information:

The Cross Bayou Canal is a 6.2-mile-long canal which was constructed in 1916 to drain land for agricultural production and to transport the products to Port Largo for shipment. The Cross Bayou Canal is the only waterway that links to both Boca Ciega Bay and Old Tampa Bay.  Ultimately, the Cross Bayou Canal improvements would be a significant addition to the County Bluewave program once the appropriate structural improvements are constructed.

The City currently maintains and will continue to maintain a kayak launch in the Cross Bayou Canal. The City will own the culvert and continue to be responsible for the roadway. The County maintains the Cross Bayou Canal where it has appropriate property rights. Replacement of the culverts, with the County and City as financial partners, is cost effective, time efficient, and provides the least disruption for adjacent properties.

 

Fiscal Impact:

The County’s contribution of $710,000.00 towards construction of project 004473A - 102nd Ave N Culvert JPA Pinellas Park is included in the FY23-FY28 Six-Year Capital Improvement Program plan: Physical Environment function; Flood Control Program; 003800A - Flood Control Program project. This project is funded by Local Infrastructure Sales Surtax (Penny for Pinellas).
