Recommended Action

Approval and execution by the County Administrator of the First Amendment to the Community Development Block Grant (CDBG) Program Subaward Specific Performance and Land Use Restriction Agreement (First Amendment) with PARC Housing, Inc. (PARC) for CDBG funded facility improvements at the Bert Mueller Group Home.

•                     This First Amendment provides an additional $22,888.50 in CDBG funding, for a total CDBG investment of $343,327.50, to cover a portion of the costs associated with unforeseen construction issues (steel deck and bedroom wall repairs, relocation of watermain and junction box, rerouting of condensate pipe) resulting in an expansion in the scope of work and increased renovation costs totaling $45,777.00.

•                     This renovation project is joint funded between the County and the City of St. Petersburg. The City is also contributing $22,888.50 to satisfy the remaining balance of the unanticipated costs.

•                     This First Amendment extends the term of Agreement CD23PARCBM three (3) months to December 31, 2024, to provide additional time for project completion, and extends the term of the Restricted Period three (3) months to January 1, 2044, restricting the use of the property to serving individuals with intellectual and developmental disabilities.

•                     This First Amendment increases the amount of required property insurance, to an amount equal to total project construction costs.

•                     On October 31, 2023, the County provided CDBG funding to PARC for costs associated with a third phase of facility improvements including bathroom renovations with American with Disabilities Act (ADA) upgrades at PARC’s Bert Mueller Group Home, located at 3190 - 75th Street North, St. Petersburg, FL 33710, benefitting approximately 48 individuals with intellectual and developmental disabilities.

•                     Funding for this agreement is included in the current-year budget of the Housing and Community Development Department in the Community Development Grant Fund.

Summary:

This First Amendment to Agreement CD23PARCBM provides additional CDBG funding; extends the term of the Agreement; extends the term of the restricted period; and increases the amount of required property insurance coverage PARC must carry through the term of the Agreement.

During the renovation project, unforeseen construction issues developed which expanded the scope of work, (steel deck and bedroom wall repairs, relocation of watermain and junction box, rerouting of condensate pipe) and increased the renovation cost by $45,777.00. PARC requested an additional $22,888.50 to cover a portion of the costs. As this is a joint funded project between the County and the City of St. Petersburg, the City will also contribute $22,888.50 to satisfy the remaining balance of the unanticipated costs.

The Agreement requires that performance be completed by September 30, 2024. PARC is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement three (3) months to December 31, 2024, as additional time is required for the completion of the third phase of the project.

As a result of the term extension, it is necessary to extend the term of the Restricted Period three (3) months to January 1, 2044, restricting the use of the property to serving individuals with intellectual and developmental disabilities.

As a result of the additional funding being provided, it is necessary to increase the amount of property insurance PARC must carry on the property to equal the amount of the CDBG funded construction costs.

Background/Explanation:

On July 18, 2023, the Board executed Resolution No. 23-56, which approved the 2023-2024 (FY24) Action Plan. The PARC Bert Muller Facility Rehabilitation Project - Phase III was approved as a facility rehabilitation activity in the Action Plan.

On October 31, 2023, the County provided CDBG funding to PARC for costs associated with a third phase of facility improvements including bathroom renovations with American with Disabilities Act (ADA) upgrades at PARC’s Bert Mueller Group Home, located at 3190 - 75th Street North, St. Petersburg, FL 33710, benefitting approximately 48 individuals with intellectual and developmental disabilities. The Agreement was effective October 1, 2023, through September 30, 2024, with the land use restriction expiring on October 1, 2043.

Fiscal Impact:

The total amount of funding for this agreement is not to exceed $343,327.50 during the term of the Agreement. Funding for this agreement is included in the current-year budget of the Housing and Community Development Department in the Community Development Grant Fund.
