Approval and execution by the County Administrator of the First Amendment to the Interlocal Agreement (Agreement) with Florida Department of Transportation (FDOT) for Water Quality Monitoring and Assessment.

                     First Amendment extends Agreement term through June 30, 2030.

                     First Amendment allows for continued FDOT annual contribution of $40,000.00 for FDOT Fiscal Years 2026 to 2030.

                     Section 3 (FDOT Cost Contribution) is deleted and replaced with updated language.

                     Section 4 contact information is updated.

                     Funding for this agreement is included in the current year budget of Public Works in the Surface Water Utility Fund.

 

Agreement term is extended through June 30, 2030; FDOT to continue contributing $40,000.00 annually through five-year period.

Summary:

​​The Agreement with FDOT allows the County to fully perform the Water Quality Monitoring Assessment Program. The First Amendment extends the Agreement term through June 30, 2030, allowing continued FDOT annual contribution of $40,000.00 through FDOT Fiscal Year 2030. Additionally, FDOT and County contact information is updated in the Amendment. The Program is required under the County’s National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer Systems (MS4) Permit as issued by Florida Department of Environmental Protection (FDEP).​

 

Background/Explanation:

​​The Public Works Division of Environmental Management has conducted surface water quality monitoring since 1991. The County and FDOT are co-permittees on the FDEP NPDES MS4 Permit. The FDEP NPDES MS4 Permit FLS000005 (MS4 Permit) is in effect as the County submitted an MS4 Permit re-application with the Cycle 4 Year 4 Annual Report to FDEP on February 28, 2023. Pursuant to Rule 62-624.420, F.A.C., the existing MS4 Permit shall not expire until FDEP has taken final action on the application for renewal or until the last day for seeking judicial review of the agency order or a later date fixed by order of the reviewing court when the renewal application is timely and sufficient.

In addition to the $40,000.00 annual contribution by FDOT, Program costs are funded annually by the County in the amount of $310,000.00, and $300,000.00 by twenty-one (21) County Agencies through separate agreement. Total annual cost for the program is $650,000.00. The County portion is included in the Public Works operating budget Surface Water Special Assessment Fund. This agreement is consistent with the Fiscal Year 2025 Adopted Budget and Fiscal Year 2026 Proposed Budget.​

 

Fiscal Impact:

The First Amendment allows for continued FDOT annual contribution of $40,000.00 for FDOT Fiscal Years 2026 to 2030, totaling $200,000.00.

Funding for this agreement is included in the current year budget of Public Works in the Surface Water Utility Fund.

 

 

Delegated Authority:

Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62 (a)(1).
