Approval and execution by the County Administrator of the First Amendment exercising a term extension to the Agreement with Brenntag Mid-South, Inc. for sodium hydroxide.
• This corrective action rectifies an incorrect amendment version signed and returned by the contractor. The attached amendment is the correct and final version.
• The contract provides sodium hydroxide to the Solid Waste Department, Keller Water Treatment Facility, and South Cross Bayou Advanced Water Reclamation Facility.
• This First Amendment exercises the first of two, twenty-four (24) month term extensions for a revised total not to exceed expenditure of $1,612,240.00 and an annual not to exceed expenditure of $403,060.00.
• Per County Code 2-188(d) and 2-62(a)(12), the County Administrator has the authority to exercise contract term extensions that were originally approved by the Board of County Commissioners.
• On July 18, 2023, the Board of County Commissioners approved this contract in the amount of $806,120.00 for a twenty-four (24) month term.
• Funding for this Agreement is included in the FY25 and FY26 budgets of Utilities in the Sewer Revenue & Operating Fund and Water Revenue and Operating Fund, as well as Solid Waste in the Solid Waste Revenue & Operating Fund.
Contract No. 23-0392-ITB increase in the amount of $806,120.00 for a revised total not to exceed $1,612,240.00 and an annual not to exceed expenditure of $403,060.00 effective through July 17, 2027.

Summary:
This contract is for membrane-grade sodium hydroxide to Solid Waste, Keller Water Treatment Facility, and South Cross Bayou Advanced Water Reclamation Facility on an as-needed basis.

On July 18, 2023, the Board of County Commissioners approved this contract in the amount of $806,120.00 for a twenty-four (24) month term with provision for two (2), twenty-four-month extensions.

Revised not to exceed expenditure: $1,612,240.00
Funding for this Agreement is included in the FY25 and FY26 budgets of Utilities in the Sewer Revenue & Operating Fund and Water Revenue and Operating Fund, as well as Solid Waste in the Solid Waste Revenue & Operating Fund.
Delegated Authority:
Authority for the County Administrator to sign this First Amendment for a term extension and the corrective action is granted under Code Section 2-188(d) and 2-62(a)(12).
