Recommended Action

Approval and execution by the Administrative Services Director of the Second Amendment to Cooperative Funding Agreement with the Southwest Florida Water Management District (SWFWMD) and the City of Clearwater (City) for the Lower Spring Branch Improvements.

 

                     Second Amendment extends Agreement five (5) years and modifies the project schedule.

                     Second Amendment replaces SWFWWD, City and County Project Managers.

                     Second Amendment updates contract language for multiple paragraphs and subparagraphs.

                     No financial impact as a result of the Second Amendment.

                     The Cooperative Funding Agreement provides funding to the City of Clearwater for the Lower Spring Branch Improvements and includes a match requirement from the City and the County.

                     The County’s obligation is budgeted in the FY24-FY29 CIP plan under Flood Prevention Program project 003800A, funded by Local Infrastructure Sales Surtax (Penny for Pinellas).

                     Second Amendment does not impact the grant award or match requirements.

Summary:

Approval of the Second Amendment allows the existing Agreement with SWFWMD and the City of Clearwater to be extended for completion of the stormwater improvements known as Lower Spring Branch Conveyance Improvements. The Agreement expiration date is revised to December 1, 2029.  The current Agreement was executed by the Board of County Commissioners on November 20, 2018.

 

Background/Explanation:

In November 2018, SWFWMD, City, and County executed an Agreement to improve conveyance in Spring Branch. This Agreement provided joint funding for the construction of the Betty Lane at Sunset Point Road Intersection Improvement project led by the County. This project has completed construction.

The Agreement also includes funding for the Douglas Avenue Culvert Bridge Replacement. The City is managing this project. The County will reimburse the City for $270,000 of the construction costs for the Douglas Avenue Culvert Bridge Replacements at the end of construction. The Douglas Avenue Crossing project has been delayed due to easement acquisitions.

 

Fiscal Impact:

The Second Amendment to the SWFWMD Cooperative Funding Agreement does not impact the grant award amount to the City of Clearwater and does not impact the match requirement for the City or the County. The Second Amendment extends the SWFWMD grant agreement from June 30th, 2024 to December 1st, 2029.

 

The County is required to reimburse the City for 25% of construction costs not to exceed $270,000 for Douglas Avenue Culvert Bridge Replacement, project 003996A. Funding for this reimbursement is budgeted in the FY24-FY29 CIP plan under Flood Prevention Program project 003800A and funded by Local Infrastructure Sales Surtax (Penny for Pinellas). The updated project schedule will impact what fiscal year in which the reimbursement should be budgeted and will be revisited during budget development of the FY26-FY31 CIP plan.

 

Delegated Authority:

Authority for the Administrative Services Director to sign this Second Amendment is granted under Code Section 2-62 (a)(1).
