Approval and execution by the County Administrator of the Second Amendment to the Community Development Block Grant (CDBG) Program Subaward Specific Performance and Land Use Restriction Agreement (Second Amendment) with Directions for Mental Health, Inc., d/b/a Directions for Living (Directions), for CDBG funded facility renovations.

 

                     This Second Amendment extends the term of Agreement CD21DMH three (3) months to December 31, 2023, to provide additional time for project completion, and extends the term of the Restricted Period three (3) months to January 1, 2044, restricting the use of the property to serving low-to moderate- income individuals and/or families.

                     The funding amount, not to exceed $443,812.00, during the term of the Agreement, remains unchanged.

                     On December 10, 2021, the County provided $273,035.00 in CDBG funding to Directions for costs associated with repairs of an existing roof structure and preparation for and installation of solar panels at the facility located at 1437 South Belcher Road, Clearwater, benefitting approximately 19,024 low- and moderate-income people.

                     On October 25, 2022, the First Amendment provided an additional $170,777.00 in CDBG funding, for a total CDBG investment of $443,812.00, to Directions for additional facility improvements, revised the project description to include roof replacement, extended the term of Agreement CD21DMH 12 months to September 30, 2023 to provide additional time for project completion, extended the term of the Restricted Period 48 months, to October 1, 2043 and increased the amount of required property insurance coverage Directions must carry through the term of the Agreement.

Summary:

This Second Amendment to the CDBG Grant Program Subaward Specific Performance and Land Use Agreement extends the term of Agreement CD21DMH three (3) months to December 31, 2023, to provide additional time for project completion, and extends the term of the Restricted Period.

The Agreement requires that performance be completed by September 30, 2023. Directions is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement three (3) months, to December 31, 2023. As a result of the term extension, it is necessary to extend the term of the Restricted Period three (3) months to January 1, 2044, restricting the use of the property to serving low- and moderate-income individuals and/or families.

 

Background/Explanation:

On July 13, 2021, the Board executed Resolution No. 21-47, which approved the 2021-2022 Action Plan. The Directions for Living Facility I Rehabilitation project was approved as a facility rehabilitation activity in the 2021-2022 Action Plan.

On December 10, 2021, the County Administrator executed CDBG Agreement CD21DMH, providing CDBG funding for improvements at the Directions for Living facility.  The Agreement was effective October 1, 2021, through September 30, 2022, with the land use restriction expiring on October 1, 2039.

Fiscal Impact:

There is no fiscal impact. The total amount of funding for this Agreement is not to exceed $443,812.00 during the term of the Agreement. Funding for this Agreement is consistent with the County’s Fiscal Year 2023 Adopted Budget and is included in the County’s Fiscal Year 2024 Budget Request for CDBG funds.

Authority for the County Administrator to sign this Amendment is granted under Code Section 2-62 (a)(1) and Resolution No. 22-60
