Approval of the ordinance amending and revising Article XII, Chapter 58, of the Pinellas County Code of Ordinances, entitled Noise Ordinance.

 

                     Updates to the ordinance will help to reduce and address loud and ruckus noise violations in residential zones.

                     The proposed amendments, includes enhanced definitions and provides clarity to existing sections relevant to noise enforcement.

                     The proposed amendments, provide a streamlined process for complaints of excessive noise when enforcement is not readily available.

                     Additional language in the ordinance, specifically addresses itinerant and transient noise in accordance with governing state statute.

                     The proposed amendments to the ordinance have no fiscal impact on Pinellas County

The proposed updates bridge the gaps where enforcement was ineffective and works to assists in the preservation of quality of life. Specifically, within residential neighborhoods. Additionally, these amendments work in conjunction with existing ordinances and offers to bring greater accountability to owners who permit excessive noise above the allowable daily thresholds and during quiet hours.

Background Information:

In recent years, the County has experienced an increase in noise complaints generated by itinerant sources. Additionally, many citizens have expressed growing concern to the influx of transient properties throughout residential zones in the unincorporated portions of the county. These drivers have helped identify areas of improvement to the existing noise ordinance. To address itinerant noise, the County streamlined both the complaint and enforcement process. Whereby reducing the number of complainants necessary to generate an investigation, as well as eliminating the warning process, when permissible, the County may now proceed directly to a hearing or citation. Additionally, the County encountered deficiencies within the existing code that created obstacles minimizing our enforcement success. The County sought to improve this process by adding terminology consistent with the expectations of the courts.
