Approval of the State funded Grant Agreement, including associated Resolution (Exhibit D) and Maintenance Memorandum of Agreement (MMOA) with the Florida Department of Transportation (FDOT), providing construction and construction engineering inspection (CEI) services for the Advanced Traffic Management System/Intelligent Transportation System (ATMS/ITS) project on State Road 580/Skinner/Main from U.S. Alternate 19/State Road 580/Broadway to U.S. 19.
• Agreement provides $334,500.00 in state funding, contributing sixteen percent for the project construction and CEI.
• County match is $1,785,648.00 (eighty-four percent) and total project estimate is $2,120,148.00.
• The County match for this Agreement is budgeted in capital project 004541A (North County ATMS Phase 2) funded by the Local Option Fuel Tax (LOFT).
• Project consists of new installation of fiber optic cable, closed circuit television cameras, and dynamic message signs.
• Project will enhance flow of traffic by providing necessary surveillance of traffic conditions along the roadway, and provide motorists with information for alerts, incidents, and evacuations.
• FDOT requires an MMOA, to be signed in conjunction with the Agreement to address future maintenance responsibilities for all fiber optic cable and ATMS devices installed including those within the Department’s right of way.
• Board of County Commissioners is required to approve the Agreement by Resolution.
• Funding is from FDOT County Incentive Grant Program (16%) and LOFT (84%).
• County is investigating the eligibility of ITS/ATMS projects for funding through ARPA to replace or add to the LOFT funds. Project will not be advertised for construction until that determination is made.
• Construction completion is expected in January 2025.

The County Incentive Grant Program (CIGP) Agreement provides state funding of sixteen percent (16%) of the construction and CEI funding required for the installation of ATMS/ITS on SR 580/Skinner/Main from US Alt 19/SR 580/Broadway to US Highway 19. Total project estimate is $2,120,148.00. Project scheduled for completion by January 13, 2025.
Project will enhance flow of traffic by providing necessary surveillance of traffic conditions along the roadway, and provide motorists with information for alerts, incidents and evacuations. Total project length is approximately three (3) miles. The project consists of new installation of fiber optic cable, CCTV cameras, and dynamic message signs (DMS). The MMOA is a requirement of the Agreement and defines County maintenance responsibilities once the project is constructed.

Background Information:
The project is part of an overall implementation of the Countywide ATMS/ITS effort that was adopted and funded by the Board of County Commissioners (Board) utilizing the Ninth Cent Local Option Fuel Tax (LOFT) in 2006.
Section 14 of the Agreement requires the County to indemnify and hold harmless the FDOT to the extent permitted by law as limited by and pursuant to the provisions of Section 768.28, Florida Statutes. County Resolution No. 06-70 prohibits the County from indemnifying others under most circumstances. FDOT will not modify the indemnification section of this Agreement as this is a standard requirement in their agreements. Staff and the County Attorney agree that the FDOT indemnification requirement is within an acceptable level of risk.
Fiscal Impact:
The County match for this Agreement is budgeted in the Capital Improvement Program, under project 004541A North County ATMS Phase 2 funded by the Local Option Fuel Tax (LOFT) at eighty-four percent (84%). The FDOT CIGP participation provides the remaining funding at sixteen percent (16%). If the project is determined eligible for funding through ARPA, funds from projects that may not make the ARPA deadline requirements may be transferred to this project to replace or add to the LOFT funding.
