Recommended Action

Approval and execution by County Administrator of the Interlocal Agreement between Pinellas County and the National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Co-Permittees for the Florida Department of Environmental Protection (FDEP) Annual Regulatory Program and Surveillance Fee (Annual Fee).

•                     This Agreement is necessary for the County and NPDES MS4 co-permittees to continue to implement the program and cost-share the state-required Annual Fee.

•                     County and twenty-one (21) municipal co-permittee’s cost-share the Annual Fee based upon jurisdictional population retrieved from the Bureau of Economic and Business Research (BEBR).

•                     Florida Department of Transportation (FDOT) is also an NPDES MS4 co-permittee which contributes to the Annual Fee based on a flat contribution of $1,875 per Chapter 62-624, F.A.C. A separate Interlocal Agreement is forthcoming.

•                     The new Agreement identifies the cost-sharing structure as established in previous years. The Annual Fee has been paid via cost-share since inception of the program (1997) without a formal Agreement in place.

The Agreement will be in effect through September 30, 2026.Body

Summary:

This agreement is required by Chapter 62-624, F.A.C. for the County and NPDES MS4 co-permittees to continue to cost-share the state-required Annual Regulatory Program and Surveillance Fee. This process has been in place without an agreement for several years and is already budgeted. This Agreement affirms this action.  The Agreement will be in effect through September 30, 2026.

Background/Explanation:

The County’s MS4 NPDES Permit, issued by FDEP, requires an interlocal agreement for all cost-sharing of the Annual Fee. The County implements the Regulatory Program and cost shares it with the NPDES MS4 Co-Permittees. This is the first documented Agreement to date, although annual payments and reimbursements have occurred since program inception in 1997.

Fiscal Impact:

The County will pay the total Annual Fee ($30,299) and will be reimbursed approximately 61% by the twenty-one (21) co-permittees* on an annual basis based on population retrieved from the Bureau of Economic and Business Research as follows:
