Approval of the Road Transfer Agreement for the transfer and acceptance of specific roadway segments and easements from the County to the City of St. Petersburg (City).
• The agreement transfers and provides acceptance of all County interest on various road segments on Martin Luther King Jr. Street North (9th Street North) from the County to the City.
• This action also transfers operation and maintenance responsibilities for Central Avenue from the County to the City.
• This transfer unifies the operation and maintenance of the functionally reclassified roadways and includes transfer of maintenance responsibilities for stormwater facilities from the County to the City.
PID No. 004192A and Sub-PID No. 004747A; County makes a one-time payment to City for $1,789,368.00 for resurfacing of Central Avenue segments that were programmed within the County’s pavement management program. Authorize the Chairman to sign and the Clerk of the Circuit Court to attest and record separately the Interlocal Agreement and the corresponding right-of-way maps (Mylars) in the official records of the County.

Summary
The Agreement provides for the transfer of jurisdiction and associated maintenance responsibilities, including stormwater facilities, for certain roadway segments in the City. The specific segments are detailed in Exhibit A to this Agreement. Total length of the segments being transferred is 8.22 centerline miles.
This agreement includes a one (1) time payment to the City in the amount of $1,789,368.00 for resurfacing of Central Avenue segments that were programmed within the County’s pavement management program.

Background Information:
The Public Works Department is partnering with County municipalities to better define right-of-way maintenance responsibility in areas where jurisdictional boundaries are shared. This Agreement serves to transfer jurisdictional responsibility for designated public roadway segments that are within, or partially within, the City municipal limits.
The County and City agree that it is in the best interest of all parties that responsibilities for operation, maintenance, planning, design and construction of the identified road segments, along with any future improvements thereto, be transferred to the City, as detailed in Exhibit A. The City accepts all legal rights of the roadway segments that are within, and appurtenant to, the right-of-way being transferred.
Fiscal Impact:
The County will make a one (1) time payment to the City in the amount of $1,789,368.00. The cost will be funded by the Local Infrastructure Sales Tax (Penny for Pinellas): Transportation Function, Road Resurfacing and Rehabilitation Program PID 004192A and Sub PID No. 004747A. Along with other programmed projects for FY21, this agreement will result in exceeding the FY21 Adopted Budget for Road Resurfacing and Rehabilitation Program. However, this does not exceed the FY21-26 Capital Improvement Plan (CIP) as the Central Avenue projects for which the one-time payment were included in that plan. A budget amendment will be brought forward as needed to realign funding within the FY21-26 CIP.
