Approval and execution by the County Administrator of Change Order No. 2 with Cone and Graham, Inc. for design build services pertaining to the Pinellas Trail Loop North Segment - Shared Use Non-Motorized Trail Program.

 

                     Approval of this contract was for the purpose of designing and constructing a 6.7 mile “North Gap” of the Pinellas Trail extending from John Chesnut Park in Palm Harbor to Enterprise Road in Clearwater, utilizing sections of the Duke Energy right-of-way to complete the trail corridor.

                     Change Order No. 2 (Final) decreases the contract by ($685,818.33) and extends the time of completion by Ninety-Nine (99) calendar days.

                     Prior actions on this contract include:

o                     Change Order No. 1 was approved by the County Administrator June 28, 2022 for a decrease to the contract by $1,898,184.17 and removal of the pedestrian bridge construction over the Lake Tarpon Outfall Canal (LTOC) and the Pinellas Trail approaches to the bridge.

o                     Phase Two construction was approved by the Board of County Commissioners (Board) on April 7, 2020, via Amendment No. 1, with a guaranteed maximum price (GMP) award amount of $9,347,046.69 plus $1,300,000 in Owner’s Contingency.

o                     Phase One design was approved by the Board on March 20, 2018, in the amount of $1,599,461.80. Work included sixty percent (60%) construction documents, GMP, final plans completion and permitting.

                     Funding is provided in part by a Florida Department of Transportation (FDOT) grant in the amount of $6,200,000.00 and the remaining County portion is derived from the Local Infrastructure Sales Tax (Penny for Pinellas): Pinellas Trail Projects, Pinellas Trail North Segment - PID No. 000967A.

 

Contract No.167-0071-NC; reduction in the amount of ($685,818.33) for a revised project total for both phases in the amount of $9,662,505.99.

Change Order No. 2 (Final) decreases the contract by ($685,818.33) and extends the time of completion by Ninety-Nine (99) calendar days.

FDOT has provided its approval for this Change Order.

 

Background/Explanation:

Contract execution and changes are outlined below:

*Phase One design was approved by the Board on March 20, 2018, in the amount of $1,599,461.80. Work was completed on February 5, 2020. 

*Phase Two construction was approved by the Board on April 7, 2020, via Amendment No. 1, with a guaranteed maximum price (GMP) award amount of $9,347,046.69 plus $1,300,000 in Owner’s Contingency. Construction commenced on June 1, 2020, and reached substantial completion on October 19, 2022.

*Change Order No. 1 decreased the agreement amount by $1,898,184,17 and removed construction of the bridge component, allowed the County to advertise the bridge as a separate construction project under Project ID No. 000967C. Staff recommended the County opt out of constructing the bridge as part of the Design Build contract due to the increase in costs. In addition to the ten percent (10%) escalation clause, which amounted to approximately $180,000.00, the contractor requested approximately $600,000.00 in additional funds for bridge construction which increased the price of the bridge by approximately $780,000.00 over the original cost.

*Change Order No. 2 (Final) decreases the contract by ($685,818.33) and extends the time of completion by Ninety-Nine (99) calendar days. Final cost: $9,662,505.99.

 

Fiscal Impact:

The project is partially funded by FDOT as part of a $6,200,000.00 Florida SUN Trail grant. The County is funding the remaining cost from the Local Infrastructure Sales Surtax (Penny) at an estimated amount of $4.2M. The project is budgeted in the Capital Improvement Plan under Pinellas Trail Projects program, under project Pinellas Trail North Segment - PID No. 000967A.
