Third Amendment to the Community Development Block Grant Program Subaward Specific Performance and Land Use Restriction Agreement CD17PERCRHB with Pinellas Ex-Offender Re-Entry Coalition, Inc., for Community Development Block Grant funded facility improvements.

 

Recommended Action:

 

Approval and execution by the County Administrator of the Third Amendment to the Community Development Block Grant Program Subaward Specific Performance and Land Use Restriction Agreement (Third Amendment) with Pinellas Ex-Offender Re-Entry Coalition, Inc. (PERC), Community Development Block Grant (CDBG) funded facility improvements.

 

                     This Third Amendment extends the term of Agreement CD17PERCRHB, 18 months to June 30, 2023, to provide additional time for project completion and extends the term of the restricted period 18 months, restricting the use of the property through June 1, 2043.

                     The funding amount, not to exceed $766,150.00 during the term of the Agreement, remains unchanged.

                     On July 25, 2019, the County provided $300,054.00 in CDBG funding to PERC for phase one (1) facility improvements at 12810 US Highway 19 North, Clearwater, FL 33764, through Agreement CD17PERCRHB.

                     On April 20, 2020, the First Amendment provided an additional $466,096.00 in CDBG funds, for a total CDBG investment of $766,150.00, to PERC for additional facility improvements, revised the project description to incorporate phase two (2) facility improvements, extended the term of the specific performance period and restricted period, and identified new CDBG grant funding Federal Award Identification Numbers.

                     On September 28, 2021, the Second Amendment extended the term of the Agreement three (3) months to December 31, 2021, to provide additional time for project completion and extended the term of the restricted period three (3) months, restricting the use of the property through December 1, 2041.

Summary:

 

This Third Amendment to Agreement CD17PERCRHB extends the term of the Agreement 18 months to allow for project completion and extends the term of the restricted period.

Due to an extensive permitting process, PERC is unable to complete the project on or before the expiration date. It is necessary to extend the term of the Agreement 18 months, to June 30, 2023. As a result of the term extension, it is necessary to extend the term of the restricted period 18 months, restricting the use of the property through June 1, 2043.

This Third Amendment will not have a fiscal impact. The total CDBG investment for this project is not to exceed $766,150.00.

 

The Agreement is effective through June 30, 2023. The use of the property is restricted to serving low-to moderate-income ex-offenders through June 1, 2043.

 

Background/Explanation

 

On June 20, 2017, the Board of County Commissioners (Board) executed Resolution 17-37, which approved the 2017-2018 Action Plan. Phase one (1) of the PERC Facility Rehabilitation project was approved as an alternate activity in the 2017-2018 Action Plan. On July 25, 2019, the County provided $300,054.00 in CDBG funding for phase one (1) of the rehabilitation project through Agreement CD17PERCRHB.

 

On July 23, 2019, the Board executed Resolution 19-48, which approved the 2019-2020 Action Plan. One of the projects to be carried out under the 2019-2020 Action Plan is Phase two (2) of the PERC Facility Rehabilitation project, benefitting ex-offenders transitioning from incarceration. On April 20, 2020, the County provided an additional $466,096.00 in CDBG funding for phase two (2) of the rehabilitation project through the First Amendment to Agreement CD17PERCRHB. On September 28, 2021, the Second Amendment extended the term of Agreement CD17PERCRHB three (3) months to December 31, 2021, to provide additional time for project completion and extended the term of the restricted period three (3) months, restricting the use of the property through December 1, 2041.

 

Fiscal Impact:

 

The total amount of funding for this project is not to exceed $766,150.00 during the term of the Agreement. Funding for this Agreement is included in the County’s Fiscal Year 2021 Adopted Budget for CDBG funds. 

Delegated Authority:

 

Authority for the County Administrator to sign this Agreement is granted under Code Section 2-62(a)(1) and Resolution No. 21-47.
