Approval of the cooperative funding agreement with the Southwest Florida Water Management District (SWFWMD) for the Pinellas Trail at 54th Avenue stormwater improvements project.

Authorize the Chairman to sign and the Clerk of the Circuit Court to attest the agreement.

SWFWMD agreement no. 17CF0000399, County PID no. 000183A for grant funding in the amount of $825,000, with a County funding obligation of $825,000, for a total anticipated construction cost of $1,650,000.

Summary:

This agreement provides fifty percent (50%) of the funding required for stormwater improvements in the area of the Pinellas Trail at 54th Avenue.  The primary objective of this project is to improve water quality and alleviate structural flooding in the area utilizing the 100-year, 24-hour storm event for flood protection.  The project will also alleviate street flooding at the intersection of the Pinellas Trail and 54th Avenue North for the 10-year, 24-hour storm event.

 

Background Information:

Construction improvements include implementation of stormwater quality treatment facilities, as well as flood control measures to improve water quality and the level of service for structures and roads.  This planned improvement encompasses a 255-acre sub-basin that ultimately discharges into Long Bayou. 

The proposed improvements will lower the 100-year floodplain elevation for structures and reduce the existing flooding problems for streets during the 10-year, 24-hour storm event.  The proposed improvements will also increase the overall 255-acre conveyance system to Long Bayou, which will provide for subsequent additional drainage improvements in the watershed. 

Additionally, section 10.1 of the agreement requires the County to indemnify SWFWMD.  Staff and the County Attorney have reviewed the indemnification language contained in the agreement and agree that it does not increase the liability to the County beyond an acceptable level of risk.  Furthermore, SWFWMD will not modify their indemnification language as it is a standard requirement in their agreements.  The agreement remains in effect through February 28, 2019.

 

Fiscal Impact:

Funding for this project is budgeted in the Capital Improvement Program: Physical Environment, Flood Control Projects program allocation.  The sources of construction funding are $825,000 from the Local Infrastructure Sales Tax (Penny for Pinellas) and $825,000 in grant funding from SWFWMD.
