Recommended Action

Approval of the Road Deed Transfer Interlocal Agreement (Agreement) with the City of Pinellas Park (City) for the transfer and acceptance of specific roadway deeds.

 

                     The County is partnering with municipalities to transfer rights-of-ways and maintenance responsibility for streets within, or partially within, municipal limits.

                     Agreement transfers deeds that are located on roadway segments that are in the jurisdiction of the receiving agency.

                     The County and the City are authorized under Florida Statutes, Section 335.0415, 335.0415(3) (2021), to enter into agreements with other governmental entities, to provide for the transfer of jurisdiction, operation and maintenance responsibilities of public roads.

 

Authorize the Chairman to sign and the Clerk of the Circuit Court to attest the Interlocal Agreement and record the Interlocal Agreement with Exhibits and separately Exhibit A and Exhibit B, the corresponding right-of-way deeds in the official records of the County.

Summary

This Agreement provides for the transfer of jurisdiction and associated maintenance responsibilities for certain deeds on road segments in the City of Pinellas Park. The specific deeds to be transferred to the City are detailed in Exhibit A and to the County in Exhibit B to this Agreement.

Background Information:

The Department of Public Works is partnering with County municipalities to better define right-of-way maintenance responsibility in areas where jurisdictional boundaries are shared.  This Agreement serves to transfer deeds for designated public road segments that are within, or partially within, the City municipal limits. The agreement transfers deeds that are located on roadway segments that are the jurisdiction of the receiving agency.

The City and County agree that it is in the best interest of the parties that responsibilities associated with the deeds be transferred to the City or County as detailed in Exhibit A and B.  The City or County accepts all legal rights of the roadway segments that are within, and appurtenant to, the right-of-way being transferred.
