Approval and execution by the County Administrator of the Florida Department of Environmental Protection (FDEP) application for the Brownfield Voluntary Cleanup Tax Credit (VCTC) incentive for affordable housing at the Dansville North Historic Landfill site.
• FDEP provides a Brownfield tax credit incentive for voluntarily cleanup contaminated sites.
• Additional tax credits are available if the site is used for affordable housing.
• This application is for a $172,502.18 tax credit.
• The tax credit will be sold on the open market at a discount of approximately 10%.
• Funding from the sale of the tax credit will be returned to the funding sources that paid for the cleanup.

Summary:
Submittal of the VCTC application will allow the County to take advantage of the VCTC affordable housing incentive resulting from the construction of affordable housing on this Brownfield site. The County is currently eligible for a tax credit in the amount of $172,502.18, subsequent to the application approval by FDEP.
Background/Explanation:
The County executed a Brownfield Site Rehabilitation Agreement with FDEP May 18, 2010. Utilizing US Environmental Protection Agency Brownfield Cleanup grant funding and Community Development Block Grant (CDBG) funding, the County removed the solid waste buried at the Dansville North Landfill site and met FDEP’s closure conditions in January 2016. The County is now eligible for an additional $172,502.18 because affordable housing was built on the site.
The total cost of the 2010 cleanup project was $876,095.44. Previous incentive applications were approved by FDEP in 2011 for $438,134.06 and in 2016 for $172,502.18, upon completion of the cleanup project. This is the final opportunity to apply for the remaining VCTC incentive. Habitat for Humanity completed construction of affordable housing in 2019.
Fiscal Impact:
Revenue of approximately 90% of the value of the corporate tax credit will be refunded to the funding sources used for the cleanup project (CDBG and Brownfield Program) in Funds 1009 and 0001 proportionate to the expenditures from each fund for the project The corporate tax credits are auctioned on the open market. Corporations who have a Florida Corporate tax liability typically purchase the certificates for approximately 90% of the face value. The anticipated revenue was not budgeted in the FY20 budget.
