Approval of a Real Property Purchase and Sale Agreement with Juan Cremades and Timera Marie Cremades-Bastarreche for the County’s sale of surplus land located between Belcher Road and Garland Circle, Palm Harbor, being a portion of Lot 5 of The Garlands subdivision; execution by the Board Chair of a County Deed; and authorization for Real Property Division staff to handle the closing.
• The County owns Lot 5 of The Garlands subdivision, designated as Property Appraiser parcel no. 07-28-16-30274-000-0050.
• The County acquired the parcel by Trustee’s Deed recorded on January 16, 1992, in Official Record 7787, Page 762, Pinellas County Public Records, for transportation purposes.

Summary

Background Information:
The County acquired the subject property for the Tampa Road widening project. In connection with the project, the entrance to The Garlands subdivision on Tampa Road was made inaccessible, therefore the County constructed a new entrance road off Belcher Road, known as Garland Way. Subsequently, the Board surplused the entire parcel (Resolution No. 23-recommend January 17, 2023).
County staff recommend selling the surplus parcel, minus the portion containing the Garland Way access road. Because the remainder piece is of insufficient size and shape to construct a single-family residence and is of use only to the sole adjoining property owners, the County is authorized to sell the remainder piece to the sole adjoiner under Section 125.35(2), Florida Statutes. The adjoining property owners have agreed to pay $137,000 to purchase the remainder (being the value determined by the Property Appraiser). Closing to occur within 30 days after full contract execution. Buyers pay all closing costs.
After the sale, County staff intend to submit a resolution to the Board to dedicate the retained portion of the parcel (Garland Way) as public right of way.
Fiscal Impact:
The County will receive sales proceeds of $137,000, to be deposited into the General Fund.
