Approval and execution by the County Administrator of a contract for sale and purchase (Contract) for a Deed of Easement (Easement) from CSX Transportation, Inc. (CSX) in favor of the County for the portion of CSX property, as specified in Exhibit A, at the 46th Avenue North railroad crossing in support of the 46th Avenue North Railroad Reconstruction project (Project).
• Purchase of the Easement is required by CSX for the County to replace the existing rail crossing and to construct a new sidewalk.
• Replacement of this rail crossing will tie into the 002131A 46th Avenue North project from 49th Street North to 37th Street North and complete improvements to the 46th Avenue North corridor.
• The purchase price of the Easement is $52,900.00.
• Funding for sub-project, 46th Ave Railroad Crossing Improvements Project 004678A, is budgeted under the Railroad Crossing Program PIV Project 004189A, included in the Capital Improvement Plan, funded by the Penny for Pinellas. Body

The County’s execution of the Contract with CSX for the Easement will grant the County necessary rights to proceed with rail crossing and sidewalk improvements at the 46th Avenue North railroad crossing for this section of the Project.Body
Background Information:
Replacement of the rail crossing supports the 002131A 46th Avenue North project from 49th Street North to 37th Street North and completes improvements to the 46th Avenue North corridor. Existing asphalt surface to be replaced with new tub (platform-type) crossing surface by CSX. County to install approach roadway paving on each side of new crossing surface. The Project will also include the addition of sidewalks, curbs, and gutters. CSX requires the County to purchase the Easement before construction on CSX property can commence.
The negotiated purchase price for the Deed of Easement is $52,900. This amount consists of an appraised value of $39,900, at $5.85 per sq ft, plus a corridor factor of 1.3258, or 32.58%, equaling an adjusted value of $7.75 per square foot. The easement area of 6,821 square feet multiplied by $7.75 results in a final rounded price of $52,900. The corridor factor accounts for the strategic connectivity of the corridor and for costs the County would otherwise incur to assemble a similar corridor-such as legal fees, staff and appraisal time, engineering design, and potential condemnation. For reference, typical corridor factors for railroad corridors range from 1.50 to 2.50. Application of a corridor factor is a standard practice required by CSX to calculate an agreeable purchase price.

The purchase price of the easement is $52,900.
