Recommended Action

Approval and execution by the County Administrator of the Settlement Agreement with the Sixth Judicial Circuit Court of Florida (Courts) to for reimbursement of services rendered during a period in which a valid contract was not in place.

 

  • This Settlement Agreement documents the agreement for services between the Courts and the County from July 1, 2024, and July 29, 2024, to allow reimbursement to Pinellas County in the amount of $37,223.78 for services provided under the Adult Post-Adjudicatory Drug Court program.
  • The Court contracted with the County under Contract #060AWQ, executed June 24, 2021, and ending June 30, 2024, to provide substance use treatment services to the Sixth Judicial Circuit Court. While a new Contract #0600DQ4 was being finalized, it was not fully executed until July 30, 2024.
  • Funds in the amount of $37,223.78 will be provided through the State of Florida Chief Financial Officer’s Office upon approval of this agreement for services provided in Fiscal Year 2024 (FY24). No match is required. No recurring funding impacts.

Summary:

Approval of this Settlement Agreement allows reimbursement to Pinellas County in the amount of $37,223.78 for services provided under the Adult Post-Adjudicatory Drug Court program between July 1, 2024, and July 29, 2024, when a valid contract had not yet been executed.

This action is necessary to formalize payment for services rendered in good faith and to avoid potential litigation costs.

 

Background/Explanation:

The Court contracted with the County under Contract #060AWQ, executed June 24, 2021, and ending June 30, 2024, to provide substance abuse treatment services to the Sixth Judicial Circuit Court. While a new Contract #0600DQ4 was being finalized, it was not fully executed until July 30, 2024.

Services provided by Pinellas County from July 1–29, 2024, were performed without a valid contract in place. The County has submitted invoices totaling $37,223.78 for reimbursement.

The Court determined it is in the best interest of the State Courts System and the State of Florida to settle payment through this agreement.

 

Fiscal Impact:

Funds in the amount of $37,223.78 will be provided through the State of Florida Chief Financial Officer’s Office upon approval of this agreement for services provided in Fiscal Year 2024 (FY24).

Funding related to original Contract #0600DQ4 with the State Courts was included in the Fiscal Year 2024 (FY24) General Fund Budget.
